A BILL
for
1 AN ACT relating to electric utilities; amending the
2 generation capacity for net metering systems; providing for
3 the aggregation of net metering systems; authorizing
4 customer-generators with specified net metering systems to
5 charge a customer-generator fee or increase in a monthly
6 fee; providing and amending definitions; and providing for
7 an effective date.

11. W.S. 37-16-101(a)(intro), (viii)(B) and by
12 creating a new paragraph (ix) and 37-16-102(a)(iii) and by
13 creating a new paragraph (iv) are amended to read:

2 (a) As used in this chapter, unless the context or a
3 specific article otherwise requires:
4
5 (viii) "Net metering system" means a facility
6 for the production of electrical energy that:
7
8 (B) Has a generating capacity of not more
9 than
10
11wenty-five (25) kilowatts

2 (iii) Shall not charge a customer-generator any
3 fee or charge that would increase the customer-generator's
4 minimum monthly charge to an amount greater than that of
5 other customers of the electric utility in the same rate
6 class as the customer-generator
