17	17	7 department; authorizing the transfer of positions and
18	18	8 funds; providing for subsequent budgeting for the Wyoming
19	19	9 state fair department; making conforming amendments; and

26	26	2 agriculture and associated functions for the state fair are
27	27	3 transferred by a type 1 transfer, as defined by W.S.
28	28	4 9-2-1707(b)(i), to the Wyoming state fair department
29	29	5 created by this act. All positions, personnel,
30	30	6 appropriations, obligations, property, equipment and
31	31	7 authority associated with the state fair shall be under the
32	32	8 control of the Wyoming state fair department as provided by
33	33	9 this act. The validity of rules, regulations, contracts,
34	34	10 agreements or other obligations of agencies or programs
35	35	11 transferred by this act shall not be affected or impaired
36	36	12 by this act.

38	38	14 (b) Notwithstanding W.S. 11-10-102(c)(vi), as amended
39	39	15 by section 3 of this act, the state fair manager previously
40	40	16 appointed by the state fair board before the effective date
41	41	17 of this act shall serve as temporary director for the
42	42	18 Wyoming state fair department upon the effective date of
43	43	19 this act. As soon as reasonably practicable after the
44	44	20 effective date of this act, the state fair board shall
45	45	21 appoint a director of the Wyoming state fair department in
46	46	22 accordance with this act.

52	52	6 As part of the reorganization of Wyoming state government,
53	53	7 there is created the Wyoming state fair department
54	54	8 consisting of the state fair division within the department
55	55	9 of agriculture as the division existed before July 1, 2025.
56	56	10 The Wyoming state fair department shall not be subject to a
57	57	11 transition period as defined in W.S. 9-2-1703(a)(ix). A
58	58	12 reorganization plan shall not be required of the director
59	59	13 of the Wyoming state fair department.

71	71	2 (a) The state fair board shall appoint an executive
72	72	3 director of the department in accordance with W.S.
73	73	4 11-10-102(c)(vi) and with the advice and consent of the
74	74	5 senate.

76	76	7 (b) The executive director's salary shall be
77	77	8 determined by the state fair board.

79	79	10 (c) The executive director shall be the chief
80	80	11 administrative officer of the department and shall have
81	81	12 general supervision of the activities, functions and
82	82	13 employees of the department, subject to the actions and
83	83	14 direction of the state fair board.

85	85	16 (d) The department shall perform all duties specified
86	86	17 by the state fair board and specified in title 11, chapter
87	87	18 10 of the Wyoming statutes.

89	89	20 (e) The department shall submit a budget in
90	90	21 accordance with W.S. 9-2-1010 through 9-2-1014.

100	100	10 (a) As part of the reorganization of Wyoming state
101	101	11 government, there is created the department of agriculture
102	102	12 consisting of the existing state department of agriculture,
103	103	13 the agricultural mediation board, the wheat marketing
104	104	14 commission, the Wyoming beef council, the Wyoming weed and
105	105	15 pest council, the board of certification of the
106	106	16 Environmental Pesticide Control Act of 1973, the weed and
107	107	17 pest board of certification, the interstate agricultural
108	108	18 grain marketing commission, the state fair advisory board
109	109	19 and, except for those programs and functions related to the
110	110	20
111	111	21 all programs and functions specified in
112	112	22 titles 11 and 35 and otherwise under law relating to
113	113	23 agriculture and livestock. Except for W.S. 9-2-1703(a)(v) 2025STATE OF WYOMING25LSO-04926HB0205
114	114	1 and (ix), the limitation of number of principal departments
115	115	2 in W.S. 9-2-1704(a) and 9-2-1707(a)(iii) and (iv), the
116	116	3 provisions of the Wyoming Government Reorganization Act of
117	117	4 1989, W.S. 9-2-1701 through 9-2-1707, apply to this
118	118	5 section.

123	123	10 The state fair board, with the assistance of the
124	124	11,
125	125	12 an annual state fair at Douglas, Wyoming dedicated to
126	126	13 honoring Wyoming's agricultural heritage and culture by
127	127	14 cultivating Wyoming's agricultural future through
128	128	15 competitions, educational displays and experiential
129	129	16 exhibits for youth producers and the general public.

141	141	7 (a) The general charge and supervision of the state
142	142	8 fair is under the state fair board with the assistance of
143	143	9 the department.

145	145	11 (b) The department shall prepare budget requests on
146	146	12 behalf of and subject to the approval of the state fair
147	147	13 board for the conduct and management of the annual state
148	148	14 fair and for the operation and maintenance of the state
149	149	15 fairgrounds, including building and facility needs for
150	150	16 major maintenance and repair.

154	154	20 (c) The state fair board shall:

156	156	22 (vi) To the extent the employment of a state

158	158	1ppoint a state fair
159	159	2 to conduct and supervise the annual state fair and
160	160	3 to manage the year round operation and maintenance of the
161	161	4 state fairgrounds. Any appointment shall be made with the
162	162	5 approval of the governor
163	163	6 and shall be subject to removal authority provided
164	164	7 by W.S. 9-1-202. The state fair board may hire and provide
165	165	8 for the supervision of other employees necessary to
166	166	9 accomplish the duties required by this chapter and may
167	167	10 contract for services to advertise and promote the annual
168	168	11 state fair and the fairgrounds;

170	170	13 (viii) Pursuant to W.S. 9-2-3204, make and
171	171	14 execute contracts and other instruments, including
172	172	15 financial contracts and instruments that the state fair
173	173	16 board determines are reasonable and advisable to carry out
174	174	17 the purposes and programs of the state fair board. The

180	180	2 money or property of any kind or character donated, granted
181	181	3 or bequeathed for any activities of the state fair. Monies
182	182	4 shall be credited to the Wyoming state fair account except
183	183	5 as otherwise provided by W.S. 11-10-107 and 11-10-118. The
184	184	6 department, on behalf of the state fair board, shall
185	185	7 include within its biennial budget request submitted under
186	186	8 W.S. 9-2-1013 a report itemizing all gifts, income and
187	187	9 expenditures under this subsection, W.S. 11-10-107 and
188	188	10 11-10-118 for each of the immediately preceding two (2)
189	189	11 fiscal years.

194	194	16 shall make reports as required by W.S. 9-2-1014 in regard
195	195	17 to the state fair.
