Atmospheric geoengineering prohibition.

A BILL
for
1 AN ACT relating to environmental quality; providing 
2 legislative findings; prohibiting atmospheric 
3 geoengineering as specified; requiring testing; providing 
4 penalties; making conforming amendments; specifying 
5 applicability; and providing for an effective date.

11 (a)  The legislature finds that:
12
13 (i)  The federal government, its agencies and 
14 other entities acting on behalf of the federal government 
15 have conducted or will conduct geoengineering experiments  2025STATE OF WYOMING25LSO-02472HB0208
1 by intentionally disbursing chemicals and other substances 
2 into the atmosphere. These geoengineering experiments may 
3 be occurring within the state of Wyoming;

5 (ii)  The risks to human health and environmental 
6 safety from broad-scale geoengineering are currently not 
7 well understood;
8
9 (iii)  The Wyoming department of environmental 
10 quality is responsible for monitoring air, land and water 
11 quality, including regulating emissions into the air, land 
12 and water within Wyoming to ensure the safety of the public 
13 while planning the development, use, reclamation, 
14 preservation and enhancement of the air, land and water 
15 resources of the state;

17 (iv)  It is the intent of the legislature to 
18 protect the public health and welfare of Wyoming residents 
19 while allowing all authorized activities permitted under 
20 state law.

7 (a)  No person shall intentionally inject, release or 
8 disperse by any means any chemicals, chemical compounds, 
9 apparatus or other substances within Wyoming into the 
10 atmosphere with the express purpose of affecting or 
11 changing temperature, weather or the intensity of the 
12 sunlight.

14 (b)  The department shall test the air quality at 
15 sites subject to geoengineering or upon receiving a report 
16 of a potential violation of subsection (a) of this section. 
17 Testing under this subsection shall, if possible, utilize 
18 transmission electron microscopy and shall determine total 
19 metals concentration in precipitation.

21 (c)  No person or governmental entity shall retaliate 
22 or otherwise harass, discipline or discriminate against any 
23 person because the person reported, in good faith, a  2025STATE OF WYOMING25LSO-02474HB0208
1 suspected violation of subsection (a) of this section or 
2 provided information related to an investigation of a 
3 suspected violation of subsection (a) of this section.

5W.S. 35-11-103(a)(xiii) is amended to 
6 read:

10 (a)  For the purpose of this act, unless the context 
11 otherwise requires:
12
13 (xiii)  "This act" means W.S. 35-11-101 through 
14 35-11-403, 35-11-405, 35-11-406, 35-11-408 through 
15 35-11-1106, 35-11-1414 through 35-11-1432, 35-11-1601 
16 through 35-11-1613, 35-11-1701, 35-11-1801 through 
17 35-11-1803, 35-11-2001 through 35-11-2004,

20Nothing in this act shall be construed to 
21 impair or alter any contract or agreement that is publicly 
22 disclosed or subject to public disclosure and that is  2025STATE OF WYOMING25LSO-02475HB0208
1 entered into with the state of Wyoming before the effective 
2 date of this act.

4.  This act is effective immediately upon 
5 completion of all acts necessary for a bill to become law 
6 as provided by Article 4, Section 8 of the Wyoming 
7 Constitution.
