7-AN ACT relating to elections; prohibiting government
8-officials and election officials from accepting private
9-funds to conduct elections as specified; prohibiting any
10-person from providing or offering private funds for
11-purposes of conducting an election; providing exceptions;
12-creating new misdemeanor offenses; and providing for an
13-effective date.
14-Be It Enacted by the Legislature of the State of Wyoming:
15-Section 1. W.S. 22-2-123 is created to read:
16-22-2-123. Private funds in elections prohibited.
17-(a) Notwithstanding any other provision of law, no
18-agency or any state or county official responsible for
19-conducting elections, including, but not limited to, a
20-county clerk, shall solicit, accept, use or dispose of any
21-donation in the form of money, grants, property or personal
22-services from an individual or nongovernmental entity for
23-the purpose of funding any type of expenses related to
24-election administration, including, but not limited to,
25-voter education, voter outreach or voter registration
26-programs. All costs and expenses relating to elections
27-shall be paid with public funds. This subsection shall not
28-apply to meals or food provided or donated in support of
29-election training or education, or to meals or food
30-provided on election day to poll workers and other election
31-staff. This section shall not apply to elections that are
32-conducted by a special district in accordance with W.S.
33-22-29-113.
34-(b) No individual or nongovernmental entity shall

42-of subsection (a) of this section.
43-(c) Nothing in this section shall be construed to
44-prohibit:
45-(i) The acceptance and expenditure of federal
46-funds for purposes of conducting elections as provided by
47-law;
48-(ii) The use of private real property for
49-purposes of use as a polling place as provided by this
