7-AN ACT relating to property taxation; specifying that if
8-multiple property tax exemptions apply to the same property
9-the exemptions shall be applied in the manner determined by
10-the department of revenue; specifying requirements for the
11-order of application of exemptions; providing an
12-appropriation; and providing for an effective date.
13-Be It Enacted by the Legislature of the State of Wyoming:
14-Section 1. W.S. 39-11-105 by creating a new
15-subsection (c) is amended to read:
16-39-11-105. Exemptions.
17-(c) For any property where more than one (1)
18-exemption applies under subsection (a) of this section, the
19-exemptions shall be applied in a manner determined by the
20-department of revenue in accordance with the following:
21-(i) If the exemption is to a portion of the
22-assessed value of the property, the exemptions shall be
23-applied in sequence so that subsequent exemptions are
24-applied to the assessed value as it is modified by the
25-application of the preceding exemption;
26-(ii) Exemptions based on a percentage of
27-property value shall be applied in the order of the
28-smallest percentage to the largest percentage;
29-(iii) Exemptions not based on a percentage of
30-property value shall be applied after any exemptions that
31-are based on a percentage of property value.

38-(a) Subject to subsection (b) of this section, there
39-is appropriated ten million five hundred thousand dollars
40-($10,500,000.00) from the general fund to the department of
41-revenue for purposes of the property tax refund program
42-under W.S. 39-13-109(c)(v). This appropriation shall be for
43-the period beginning with the effective date of this act
44-and ending June 30, 2026. This appropriation shall not be
45-transferred or expended for any other purpose and any
46-unexpended, unobligated funds remaining from this
47-appropriation shall revert as provided by law on June 30,
48-2026.
49-(b) If 2025 Senate File 0001 or 2025 House Bill 0001
50-is enacted into law, the appropriation in subsection (a) of
51-this section shall be reduced by one dollar ($1.00) for
52-every one dollar ($1.00) appropriated to the department of
53-revenue for the property tax refund program under W.S.
54-39-13-109(c)(v) in 2025 Senate File 0001 or 2025 House Bill
