13	13	3 specified services; authorizing hospitals to apply to the
14	14	4 department of health to waive obstetrics, labor and
15	15	5 delivery services as specified; making conforming
16	16	6 amendments; and providing for an effective date.

25	25	2 whose support, either in whole or in part, is derived from
26	26	3 public funds and provides inpatient acute care shall:
27	27	4
28	28	5 (i) Offer the following minimum services as
29	29	6 defined by the department:
30	30	7
31	31	8 (A) Emergency services;
32	32	9
33	33	10 (B) Radiology services;
34	34	11
35	35	12 (C) Laboratory services; and
36	36	13
37	37	14 (D) Nursing services.

39	39	16 (ii) Offer, subject to the waiver provision of
40	40	17 subsection (b) of this section, obstetrics, labor and
41	41	18 delivery services.

43	43	20 (b) A hospital licensed by the department whose
44	44	21 support, either in whole or in part, is derived from public
45	45	22 funds and that seeks to waive the requirement to offer
46	46	23 obstetrics, labor and delivery services under paragraph 2025STATE OF WYOMING25LSO-06803HB0284
47	47	1 (a)(ii) of this section shall submit an application to the
48	48	2 department. The application shall include:
49	49	3
50	50	4 (i) Sufficient information to demonstrate one of
51	51	5 the following:
52	52	6
53	53	7 (A) Continued maintenance of obstetrics,
54	54	8 labor and delivery services would place undue financial
55	55	9 hardship on the hospital;
56	56	10
57	57	11 (B) That patient volume for the obstetrics,
58	58	12 labor and delivery services is too low to ensure staff
59	59	13 competency and availability; or

61	61	15 (C) Personnel, equipment or medical
62	62	16 expertise necessary to provide obstetrics, labor and
63	63	17 delivery services are not reasonably available at the
64	64	18 hospital.

66	66	20 (ii) A signed letter from the board of county
67	67	21 commissioners in the county where the hospital is located
68	68	22 if the hospital is operated by the state or a political
69	69	23 subdivision of the state, or, if a publicly owned hospital, 2025STATE OF WYOMING25LSO-06804HB0284
70	70	1 a signed letter from the applicable hospital board of
71	71	2 trustees, that:

73	73	4 (A) Attests to the fact that the waived
74	74	5 obstetrics, labor and delivery services cannot be provided
75	75	6 at the hospital, pursuant to paragraph (b)(i) of this
76	76	7 section; and

78	78	9 (B) Concurs with the hospital's rationale
79	79	10 for requesting the waiver.

81	81	12 (c) When a complete application for a waiver is
82	82	13 submitted, the department shall make a determination on the
83	83	14 waiver not later than thirty (30) calendar days after
84	84	15 receiving the application. The department may waive the
85	85	16 requirements of subsection (a) of this section if the
86	86	17 elements of paragraph (b)(i) of this section are proven by
87	87	18 the applicable hospital.

89	89	20 (d) As used in this section, "hospital" means as
90	90	21 defined by W.S. 35-2-901(a)(xiii)(A) and
91	91	22 35-2-901(a)(xiii)(C).
