1111 1 AN ACT relating to public health and safety; requiring

1313 3 specified services; authorizing hospitals to apply to the

1515 5 delivery services as specified; making conforming
1616 6 amendments; and providing for an effective date.

2424 14 2025STATE OF WYOMING25LSO-06802HB02841 (a) A hospital licensed through the department and
2525 2 whose support, either in whole or in part, is derived from
2626 3 public funds and provides inpatient acute care shall:

2828 5 (i) Offer the following minimum services as
2929 6 defined by the department:

3131 8 (A) Emergency services;

3333 10 (B) Radiology services;

3535 12 (C) Laboratory services; and

3737 14 (D) Nursing services.

3939 16 (ii) Offer, subject to the waiver provision of
4040 17 subsection (b) of this section, obstetrics, labor and
4141 18 delivery services.

4343 20 (b) A hospital licensed by the department whose
4444 21 support, either in whole or in part, is derived from public
4545 22 funds and that seeks to waive the requirement to offer
4646 23 obstetrics, labor and delivery services under paragraph 2025STATE OF WYOMING25LSO-06803HB0284
4747 1 (a)(ii) of this section shall submit an application to the
4848 2 department. The application shall include:

5050 4 (i) Sufficient information to demonstrate one of
5151 5 the following:

5353 7 (A) Continued maintenance of obstetrics,
5454 8 labor and delivery services would place undue financial
5555 9 hardship on the hospital;

5757 11 (B) That patient volume for the obstetrics,
5858 12 labor and delivery services is too low to ensure staff
5959 13 competency and availability; or

6161 15 (C) Personnel, equipment or medical
6262 16 expertise necessary to provide obstetrics, labor and
6363 17 delivery services are not reasonably available at the
6464 18 hospital.

6666 20 (ii) A signed letter from the board of county
6767 21 commissioners in the county where the hospital is located
6868 22 if the hospital is operated by the state or a political

7070 1 a signed letter from the applicable hospital board of
7171 2 trustees, that:

7373 4 (A) Attests to the fact that the waived
7474 5 obstetrics, labor and delivery services cannot be provided
7575 6 at the hospital, pursuant to paragraph (b)(i) of this
7676 7 section; and

7878 9 (B) Concurs with the hospital's rationale
7979 10 for requesting the waiver.

8181 12 (c) When a complete application for a waiver is
8282 13 submitted, the department shall make a determination on the
8383 14 waiver not later than thirty (30) calendar days after
8484 15 receiving the application. The department may waive the
8585 16 requirements of subsection (a) of this section if the
8686 17 elements of paragraph (b)(i) of this section are proven by
8787 18 the applicable hospital.

8989 20 (d) As used in this section, "hospital" means as
9090 21 defined by W.S. 35-2-901(a)(xiii)(A) and
9191 22 35-2-901(a)(xiii)(C).
