| 28 | 28 | | 4 pecuniary damage resulting from the illegal actions of the |
|---|
| 29 | 29 | | 5 person. Restitution may be excused if a court finds that |
|---|
| 30 | 30 | | 6 the defendant has no ability to pay. In determining the |
|---|
| 31 | 31 | | 7 amount of restitution under this subsection, the court |
|---|
| 32 | 32 | | 8 shall consider, and include as a special finding, the |
|---|
| 33 | 33 | | 9 reasonably foreseeable actual pecuniary damage that has or |
|---|
| 34 | 34 | | 10 will result from the illegal activities of the defendant. |
|---|
| 35 | 35 | | 11 Any restitution received under this subsection shall be |
|---|
| 36 | 36 | | 12 deposited into an account designated by the board for use |
|---|
| 37 | 37 | | 13 to restore the rights and property of the board. The acts |
|---|
