15	15	6 legislative approval; and providing for an effective date.

25	25	2 act of the legislature pursuant to subsection (c) of this
26	26	3 section and notwithstanding W.S. 21-2-301 et seq., not
27	27	4 later than July 1, 2026, all divisions, programs and
28	28	5 functions of the state board of education and the state
29	29	6 board of career and technical education shall be
30	30	7 transferred to the state superintendent of public
31	31	8 instruction. On and after July 1, 2026, any statute, rule
32	32	9 or legal or other document that refers to the state board
33	33	10 of education or the state board of career and technical
34	34	11 education shall mean the state superintendent of public
35	35	12 instruction.

37	37	14 (b) The state superintendent of public instruction
38	38	15 shall prepare a plan for reorganization of the state board
39	39	16 of education and the state board of career and technical
40	40	17 education under the state superintendent. The
41	41	18 reorganization plan shall:

43	43	20 (i) Maintain the current structure and operation
44	44	21 of the state board of education and the state board of
45	45	22 career and technical education to the maximum extent

47	47	1 functions of the state board of education and the state
48	48	2 board of career and technical education are assigned to the
49	49	3 state superintendent upon adoption of the reorganization
50	50	4 plan by the legislature;

52	52	6 (ii) Require the state superintendent to perform
53	53	7 the administrative functions assigned by this section. The
54	54	8 state superintendent may appoint administrators and
55	55	9 managers who may serve as the administrative heads of
56	56	10 divisions and programs created by the state superintendent
57	57	11 for the purpose of executing the functions assigned by this
58	58	12 section;

60	60	14 (iii) Identify statutory amendments, rule and
61	61	15 procedural amendments and other regulatory amendments that
62	62	16 will be necessary to accomplish the reorganization required
63	63	17 by this section;

65	65	19 (iv) Provide for the transfer of all personnel,
66	66	20 supplies, equipment and appropriations of and for the state
67	67	21 board of education and the state board of career and
68	68	22 technical education to the state superintendent;

70	70	2 relevant to the reorganization required by this section.

72	72	4 (c) The state superintendent of public instruction
73	73	5 shall submit the reorganization plan required by subsection
74	74	6 (b) of this section to the governor, the joint
75	75	7 appropriations committee and the joint education interim
76	76	8 committee on or before July 1, 2025. The state
77	77	9 superintendent shall make the plan available to the public
78	78	10 on or before July 1, 2025. The joint appropriations
79	79	11 committee and the joint education interim committee shall
80	80	12 each hold at least one (1) public hearing regarding the
81	81	13 reorganization plan before convening of the legislature for
82	82	14 the 2026 budget session and may draft appropriate
83	83	15 legislation utilizing the reorganization plan for
84	84	16 introduction for the 2026 budget session. It is the intent
85	85	17 of the legislature that the reorganization plan be
86	86	18 implemented not later than July 1, 2026.

88	88	20 (d) Unless otherwise directed in an approved
89	89	21 reorganization plan, the duties, powers and functions of
90	90	22 the state board of education and the state board of career
91	91	23 and technical education shall remain unchanged until July 2025STATE OF WYOMING25LSO-04565HB0315
92	92	1 1, 2026, after which time the state superintendent shall be
93	93	2 the successor to the state board of education and the state
94	94	3 board of career and technical education.

113	113	22 contracts, amendments or other obligations of the state

115	115	1 technical education are not affected by this act. The rules
116	116	2 and regulations of the state board of education and the
117	117	3 state board of career and technical education shall remain
118	118	4 in effect until amended or repealed by rules and
119	119	5 regulations adopted by the state superintendent following
120	120	6 approval by the legislature of the reorganization plan
121	121	7 required by W.S. 21-2-301.1(b).

123	123	9This act is effective immediately upon
124	124	10 completion of all acts necessary for a bill to become law
125	125	11 as provided by Article 4, Section 8 of the Wyoming
126	126	12 Constitution.
