11+1 A JOINT RESOLUTION requesting Congress to introduce a bill
12+2 and enact law to amend Wyoming's act of admission to authorize
13+3 the expenditure of earnings for the support of the common
14+4 schools in Wyoming.

16+6 WHEREAS, on July 10, 1890, the United States Congress enacted
17+7 the Act of Admission that admitted Wyoming as a state in the
18+8 United States of America; and

20+10 WHEREAS, the Act of Admission granted the state of Wyoming
21+11 two (2) sections of land in every township for the support of
22+12 common schools; and
23+13
24+14 WHEREAS, the Act of Admission specified that any proceeds

27+1 constitute a permanent school fund, "the interest of which
28+2 only shall be expended in the support of said schools"; and

30+4 WHEREAS, the Act of Admission specified that a percentage of
31+5 the proceeds of the sales of federal public lands in Wyoming
32+6 were to constitute a permanent fund, "the interest of which
33+7 only shall be expended for the support of the common schools"
34+8 in Wyoming; and

36+10 WHEREAS, the Act of Admission specified that certain
37+11 previously granted lands constituted a permanent fund, with
38+12 the interest and income to be used for university purposes;

41+15 WHEREAS, the state created the common school account within
42+16 the permanent land fund in accordance with the requirements
43+17 of the Act of Admission and Article 7, Section 2 of the
44+18 Wyoming Constitution; and

46+20 WHEREAS, the common school account within the permanent land
47+21 fund has grown over the years and has been invested to where
48+22 the current value of the fund exceeds four billion dollars

9-and enact law to amend Wyoming's act of admission to authorize
10-the expenditure of earnings for the support of the common
11-schools in Wyoming.
12-WHEREAS, on July 10, 1890, the United States Congress enacted
13-the Act of Admission that admitted Wyoming as a state in the
14-United States of America; and
15-WHEREAS, the Act of Admission granted the state of Wyoming
16-two (2) sections of land in every township for the support of
17-common schools; and
18-WHEREAS, the Act of Admission specified that any proceeds
19-from the disposition of granted school lands were to
20-constitute a permanent school fund, "the interest of which
21-only shall be expended in the support of said schools"; and
22-WHEREAS, the Act of Admission specified that a percentage of
23-the proceeds of the sales of federal public lands in Wyoming
24-were to constitute a permanent fund, "the interest of which
25-only shall be expended for the support of the common schools"
26-in Wyoming; and
27-WHEREAS, the Act of Admission specified that certain
28-previously granted lands constituted a permanent fund, with
29-the interest and income to be used for university purposes;

31-WHEREAS, the state created the common school account within
32-the permanent land fund in accordance with the requirements
33-of the Act of Admission and Article 7, Section 2 of the

54+4 addition to interest and income generated from the funds; and

56+6 WHEREAS, an amendment to Wyoming's Act of Admission that would
57+7 replace references to "interest" and "income" with references
58+8 to "earnings" will better reflect the reality of how the
59+9 common school account is invested and will allow the earnings
60+10 that are generated from the investment of the permanent funds
61+11 of the common school account to be better and more efficiently
62+12 applied for the benefit of Wyoming's public schools.

84+10 shall be disposed of only at public sale, the
85+11 proceeds to constitute a permanent school fund, the
86+12 of which only shall be expended
87+13 in the support of said schools. But said lands may,
88+14 under such regulations as the legislature shall
89+15 prescribe, be leased for mineral, grazing,
90+16 agricultural, or other purposes, provided that the
91+17 term of agricultural and grazing leases shall not

44-million dollars ($5,600,000,000.00); and
45-WHEREAS, the investment of the funds in the common school
46-account generates earnings and capital gains that are in
47-addition to interest and income generated from the funds; and
48-WHEREAS, an amendment to Wyoming's Act of Admission that would
49-replace references to "interest" and "income" with references
50-to "earnings" will better reflect the reality of how the
51-common school account is invested and will allow the earnings

55-NOW, THEREFORE, BE IT RESOLVED BY THE MEMBERS OF THE
56-LEGISLATURE OF THE STATE OF WYOMING:
57-Section 1. That the Wyoming Legislature requests that
58-members of Wyoming's congressional delegation introduce, and
59-that Congress enact, legislation that will amend Wyoming's
60-Act of Admission to strike references to "interest" in
61-sections 5 and 7 of the Act of Admission and to insert
62-references to "earnings" and to strike the reference to
63-"income" in section 8 and insert a reference to "earnings."
64-Section 2. That members of Wyoming's congressional
65-delegation and Congress consider introducing legislation that
66-makes the following changes to sections 5, 7 and 8 of the Act
67-of Admission as follows:

75-All lands herein granted for educational purposes
76-shall be disposed of only at public sale, the
77-proceeds to constitute a permanent school fund, the
78-interest of which only shall be expended
79-in the support of said schools. But said lands may,
80-under such regulations as the legislature shall
81-prescribe, be leased for mineral, grazing,
82-agricultural, or other purposes, provided that the
83-term of agricultural and grazing leases shall not
84-exceed 10 years; and such land shall not be subject
85-to preemption, homestead entry, or any other entry
86-under the land laws of the United States, whether
87-surveyed or unsurveyed, but shall be reserved for
88-school purposes only.

93-said state into the union, after deducting all the
94-expenses incident to the same, shall be paid to the
95-said state, to be used as a permanent fund, the
96-interest of which only shall be expended
97-for the support of the common schools within said
98-state.
99-Section 8.
100-The lands granted to the Territory of Wyoming by
101-the act of February 18, 1881, entitled "An act to
102-grant lands to Dakota, Montana, Arizona, Idaho and
103-Wyoming, for university purposes," are hereby ORIGINAL HOUSE ENGROSSED

109-4vested in the State of Wyoming, to the extent of
110-the full quantity of 72 sections to said state, and
111-any portion of said lands that may not have been
112-selected by said Territory of Wyoming may be
113-selected by the said state; but said act of February
114-18, 1881, shall be so amended as to provide that
115-none of said lands shall be sold for less than $10
116-per acre, and the proceeds shall constitute a
117-permanent fund to be safely invested and held by
118-said state, and the
119-exclusively for university purposes. The schools,
120-colleges, and universities provided for in this act
121-shall forever remain under exclusive control of
122-said state, and no part of the proceeds arising
123-from the sale or disposal of any lands herein
124-granted for educational purposes shall be used for
125-the support of any sectarian or denominational
126-school, college, or university. The section of land
127-granted by the act of May 28, 1888, to the Territory
128-of Wyoming for a fish hatchery and other public
129-purposes shall, upon the admission of said State of
130-Wyoming into the union, become the property of said
