7-AN ACT relating to criminal procedure; amending the
8-definition of peace officer to clarify and expand the scope
9-of authority for park rangers, superintendents and
10-assistant superintendents; making conforming amendments;
11-and providing for an effective date.
12-Be It Enacted by the Legislature of the State of Wyoming:
13-Section 1. W.S. 6-1-104(a)(vi)(P), 7-2-101(a)(iv)(G),
14-7-2-106(e)(ii) and 35-7-1002(a)(xxiv) are amended to read:
15-6-1-104. Definitions.
16-(a) As used in this act, unless otherwise defined:
17-(vi) "Peace officer" includes the following
18-officers assigned to duty in the state of Wyoming:
19-(P) Any superintendent, assistant
20-superintendent, park ranger
21-or reserve park ranger of any state park, state recreation
22-area, state archeological site or state historic site who
23-has qualified pursuant to W.S. 9-1-701 through 9-1-707,
24-when acting within the boundaries of the state park, state
25-recreation area, state archeological site or state historic
26-site or when
27-officers acting within the scope
28-following observation or discovery of the commission of a
29-felony which was observed or discovered during the
30-performance of their official duties; in their own
31-jurisdiction;

39-(iv) "Peace officer" means:
40-(G) Any superintendent, assistant
41-superintendent, park ranger
42-or reserve park ranger of any state park, state recreation
43-area, state archeological site or state historic site who
44-has qualified pursuant to W.S. 9-1-701 through 9-1-707,
45-when acting within the boundaries of the state park, state
46-recreation area, state archeological site or state historic
47-site,
48-officers performing
49-observation or discovery of the commission of a felony
50-which was observed or discovered during the performance of
51-their official duties;
52-7-2-106. Extraterritorial authority of peace
53-officers; requests for assignment of peace officers;
54-liability; compensation.
55-(e) Nothing in this section shall be construed to
56-authorize a peace officer:
57-(ii) As defined in W.S. 7-2-101(a)(iv)(E)
58-to act pursuant to paragraph (a)(ii) or (iii) or subsection
59-(b) of this section; or

61-(a) As used in this act:
62-(xxiv) "Law enforcement officer" means any
63-sheriff, undersheriff or sheriff's deputy of any county of
64-this state, any duly authorized municipal policeman of any

71-highway patrol, any police officer of the University of
72-Wyoming or any Wyoming community college who is a peace
73-officer, any superintendent, assistant superintendent,
74-full-time park ranger
75-ranger
76-archeological site or state historic site who has qualified
77-pursuant to W.S. 9-1-701 through 9-1-707, when acting
78-within the boundaries of the state park, state recreation
79-area, state archeological site or state historic site or
80-when
81-enforcement officers acting within the scope of their
82-official duties in their own jurisdiction
83-statutes following observation or discovery of the
84-commission of a felony which was observed or discovered
85-during the performance of their official duties, or any
86-special agent employed by the commissioner under this act; ORIGINAL SENATE
