8		-	requiring the provision of notice to tribal governments of
9		-	applications for industrial siting permits; making
10		-	conforming amendments; requiring rulemaking; specifying
11		-	applicability; and providing for effective dates.
12		-	Be It Enacted by the Legislature of the State of Wyoming:
13		-	Section 1. W.S. 35-12-102(a) by creating a new
14		-	paragraph (xvi), 35-12-107(c) by creating a new paragraph
15		-	(iv), (d)(ii) and (g)(ii) and 35-12-110(a) by creating a
16		-	new paragraph (iv) and (f)(ii) are amended to read:
17		-	35-12-102. Definitions.
18		-	(a) As used in this chapter:
19		-	(xvi) "Tribal government" means the tribal
20		-	government of the Eastern Shoshone tribe, the tribal
21		-	government of the Northern Arapaho tribe of the Wind River
22		-	Indian Reservation and the cooperative tribal governing
23		-	body.
24		-	35-12-107. Request for waiver of permit application;
25		-	form.
26		-	(c) Not more than seven (7) days following receipt of
27		-	a request for a waiver, the director shall:
28		-	(iv) Serve notice of the request upon each
29		-	tribal government located within the same or adjacent
30		-	county to where the industrial facility will be located.
31		-	(d) Not more than fourteen (14) days following

39		-	if applicable,
40		-	for proposed facilities meeting the requirements of W.S.
41		-	35-12-102(a)(vii)(E), (F) or (G), notify affected
42		-	landowners;
43		-	(g) Not more than fifty (50) days following receipt
44		-	of a request, the director shall:
45		-	(ii) Notify the applicant, tribal governments,
46		-	if applicable,
47		-	for proposed facilities meeting the requirements of W.S.
48		-	35-12-102(a)(vii)(E), (F) or (G), notify affected
49		-	landowners;
50		-	35-12-110. Service of notice of application;
51		-	information and recommendations; application deficiencies;
52		-	procedure; jurisdiction; hearing.
53		-	(a) Not more than ten (10) days following receipt of
54		-	an application for a permit, the director shall:
55		-	(iv) Serve an electronic or physical copy of the
56		-	application and notice of hearing upon each tribal
57		-	government located within the same or adjacent county to
58		-	where the industrial facility will be located.
59		-	(f) Not more than ninety (90) days after receipt of
60		-	an application for a permit, the director shall:
61		-	(ii) Notify the applicant, tribal governments,
62		-	if applicable,

82		-	(a) Except as provided in subsection (b) of this
83		-	section, this act is effective July 1, 2025.
84		-	(b) Sections 3 and 4 of this act are effective
85		-	immediately upon completion of all acts necessary for a
86		-	bill to become law as provided by Article 4, Section 8 of
87		-	the Wyoming Constitution.
