7-AN ACT relating to alcoholic beverages; authorizing resort
8-hotel liquor licenses; specifying requirements for the
9-resort hotel liquor license and licensees; making
10-conforming amendments; providing and amending definitions;
11-and providing for an effective date.
12-Be It Enacted by the Legislature of the State of Wyoming:
13-Section 1. W.S. 12-4-416 is created to read:
14-12-4-416. Resort hotel liquor licenses; authorized;
15-requirements.
16-(a) The appropriate licensing authority in a county,
17-city or town may issue resort hotel liquor licenses to
18-applicants who are owners or lessees of a resort hotel that
19-satisfies all requirements specified in subsection (b) of
20-this section.
21-(b) To qualify for a resort hotel liquor license
22-under this section, the appropriate licensing authority
23-shall require the resort hotel to:
24-(i) Have an actual valuation of, or the
25-applicant shall commit to expend or have actually expended
26-on the resort hotel, not less than five million dollars
27-($5,000,000.00). Any valuation under this paragraph shall
28-include the value of the land on which the resort hotel is
29-located;
30-(ii) Include a full-service restaurant that
31-shall be open during regular business hours. At the
32-discretion of the appropriate licensing authority,
33-variances to this time requirement may be granted on a

40-restaurant" means a restaurant where waiters deliver food
41-and drink offered from a printed food menu to patrons at
42-tables or booths and that has a dining room or rooms,
43-kitchen and the number and kind of employees necessary for
44-the preparing, cooking and serving of meals;
45-(iii) Include within the resort hotel not less
46-than twenty (20) sleeping rooms for short-term occupancy;
47-(iv) Provide dining services to guest rooms for
48-not less than twelve (12) hours each day; and
49-(v) Provide facilities for business meetings
50-that can accommodate not less than fifty (50) participants.
51-Section 2. W.S. 12-1-101(a)(viii)(intro), (T) and by
52-creating a new subparagraph (W), 12-4-103(a)(iii), 12-4-403
53-through 12-4-405, 12-4-414(b)(iv), 12-4-415(b)(iv) and
54-12-5-201(f) are amended to read:
55-12-1-101. Definitions.
56-(a) As used in this title:
57-(viii) "Licensee" means a person holding
58-one (1) or more of the following:
59-(T) Special malt beverage permit issued
60-under W.S. 12-4-504; or
61-(W) Resort hotel liquor license.

68-3(a) A license or permit authorized by this title
69-shall not be held by, issued or transferred to:
70-(iii) Any person who does not own the building
71-or hold a written lease for the period for which the
72-license will be effective containing an agreement by the
73-lessor that alcoholic or malt beverages may be sold upon
74-the leased premises, except as provided by paragraph (iv)
75-of this subsection. This paragraph shall not be interpreted
76-to prevent the use of a resort liquor license
77-hotel liquor license by a contractor or subcontractor as
78-permitted by W.S. 12-4-403(b);

81-(a) The provisions authorizing resort liquor licenses
82-and resort hotel liquor licenses shall have no application
83-to the population formula limiting retail liquor licenses
84-as provided by W.S. 12-4-201.
85-(b) A resort liquor licensee
86-licensee may contract or subcontract for the provision of
87-food and beverage services on the licensed premises.
88-However, the

140-resort retail liquor license, a golf club that holds a
141-retail liquor license, a restaurant liquor license or a
142-club limited retail liquor license or a holder of a retail
143-liquor license or restaurant liquor license operating on a
144-guest ranch may dispense alcoholic beverages from any
145-location within the boundaries of the licensee's premises.
146-Any holder of a resort hotel liquor license may sell an
147-unopened bottle of liquor or wine to a registered guest not
148-less than twenty-one (21) years of age for consumption on
149-the holder's premises. The premises shall be a single
150-property within a contiguous boundary upon which the
151-licensee is located and which shall be identified in the
152-license. Any location on the premises where alcoholic
153-beverages are dispensed as approved by the licensing
154-authority shall comply with applicable sanitation and fire
155-hazard requirements and other applicable laws. The
156-licensing authority shall, as often as necessary, inspect
157-the licensed location where alcoholic beverages are
158-dispensed to ensure that the licensee is in compliance with
