9 | | - | States of America; authorizing labeling for beef that is a |

10 | | - | product of the state of Wyoming; providing definitions; |

11 | | - | making conforming amendments; and providing for an |
---|

13 | | - | Be It Enacted by the Legislature of the State of Wyoming: |
---|
14 | | - | Section 1. W.S. 35-7-111(a)(xiii)(A) and |
---|
15 | | - | 35-7-119(e)(ii), by creating new paragraphs (iii) through |
---|
16 | | - | (v) and by amending and renumbering (iii) as (vi) are |
---|
17 | | - | amended to read: |
---|
18 | | - | 35-7-111. Prohibited acts. |
---|
19 | | - | (a) No person shall: |
---|
20 | | - | (xiii) Include the term "meat" or any synonymous |
---|
21 | | - | term for meat or a specific animal species in labeling, |
---|
22 | | - | advertising or other sales promotion unless the product: |
---|
23 | | - | (A) Is consistent with the definition of |
---|
24 | | - | meat in W.S. 35-7-119(e)(iii)(A) 35-7-119(e)(vi)(A); and |
---|
25 | | - | 35-7-119. Fair packaging and labeling provisions. |
---|
26 | | - | (e) The department shall promulgate rules with |
---|
27 | | - | respect to labeling. Every retailer and every wholesaler |
---|
28 | | - | who sells or offers for sale in this state through an |
---|
29 | | - | establishment or otherwise any: |
---|
30 | | - | (ii) Cell cultured or plant based products not |
---|
31 | | - | consistent with the definition of meat in subparagraph |
---|
32 | | - | (iii)(A) of this subsection and not derived from ORIGINAL SENATE ENGROSSED |

39 | | - | as those terms are defined in W.S. 11-26-101(a), |

40 | | - | 11-32-101(a)(iv), 23-1-101(a)(xiii) and 23-1-102(a)(xvi), |
---|
41 | | - | shall clearly label cell cultured products as "containing |
---|
42 | | - | cell cultured product" and clearly label plant based |
---|
43 | | - | products as "vegetarian", "veggie", "vegan", "plant based" |
---|
44 | | - | or other similar term indicating that the product is plant |
---|
45 | | - | based; |
---|
46 | | - | (iii) Only beef that is derived from cattle |
---|
47 | | - | born, raised, slaughtered and processed in the United |
---|
48 | | - | States may clearly be labeled as a product of the United |
---|
49 | | - | States of America; |
---|
50 | | - | (iv) Only beef that is derived from cattle born |
---|
51 | | - | and raised in the state of Wyoming may clearly be labeled |
---|
52 | | - | as a product of Wyoming; |
---|
53 | | - | (v) Beef that is of undeterminable origin or |
---|
54 | | - | that has not been born, raised, slaughtered and processed |
---|
55 | | - | in the United States of America shall not be labeled as a |
---|
56 | | - | product of the United States of America; |
---|
57 | | - | (iii)(vi) As used in this subsection: |
---|
58 | | - | (A) "Meat" means the edible part of the |
---|
59 | | - | muscle of animals, which is skeletal or which is found in |
---|
60 | | - | the tongue, in the diaphragm, in the heart or in the |
---|
61 | | - | esophagus, with or without the accompanying or overlying |
---|
62 | | - | fat, and the portions of bone, skin, sinew, nerve and blood |
---|
63 | | - | vessels which normally accompany the muscle tissue and |
---|
64 | | - | which are not separated from it in the process of dressing, |
