A BILL
for
1 AN ACT relating to public health and safety; authorizing
2 the department of health to approve alterations or
3 additions to health care facilities for purposes of health
4 care and life safety compliance determinations only;
5 repealing bed expansion limitations for nursing care
6 facilities and hospitals as specified; requiring reports;
7 and providing for an effective date.

11. W.S. 35-2-906(a) is amended to read:

2 (a) A licensee who contemplates construction of or
3 alteration or addition to a health care facility shall
4 submit plans and specifications to the division for
5 preliminary inspection and approval prior to commencing
6 construction. Significant changes to the original plans
7 must also be submitted and approved prior to
8 implementation. The plans and any changes shall indicate
9 any increase in the number of beds.

14W.S. 35-2-901(a)(v) and 35-2-906(b), (c),
15 (f) and (g) are repealed.

17. On or before September 1, 2029, the
18 department of health shall report to the joint labor,
19 health and social services interim committee on the status
20 of construction of nursing care facilities and whether
21 hospitals and nursing care facilities are positively or
22 adversely affected by this act.
