W.S. 34-1-159 is created to read: 14 2025STATE OF WYOMING25LSO-02932SF01051 2 3 4 5 (a) As used in this section: 6 7 (i) "Federal government" means the United States 8 or any agency or instrumentality thereof; 9 10 (ii) "Real property" means all interests in real 11 property, including but not limited to, the fee estate, 12 leasehold interests, easements, rights‑of‑way, subsurface 13 interests, airspace interests, water rights and mineral 14 interests. 15 16 (b) No person shall sell or transfer real property in 17 this state to the federal government unless the person 18 acquires consent from the Wyoming legislature. 19 20 (c) To acquire consent from the Wyoming legislature 21 as required by subsection (b) of this section, a person 22 selling or transferring real property in this state to the 23 federal government shall submit to the legislative service 2025STATE OF WYOMING25LSO-02933SF0105 1 office before a legally binding agreement is entered into 2 by the person and the federal government: 3 4 (i) A notice of intent to sell or transfer the 5 real property in this state to the federal government; and 6 7 (ii) Evidence that the federal government would 8 be acquiring the real property in this state pursuant to an 9 enumerated constitutional power which may involve the 10 exercise of the federal power of eminent domain. 11 12 (d) If a person fails to submit the information 13 required by subsection (c) of this section before a legally 14 binding agreement is entered into by the person and the 15 federal government to sell or transfer real property in 16 this state to the federal government, the person shall be 17 liable for a civil penalty in an amount equal to the net 18 proceeds received from the sale or transfer of the real 19 property. 20 21 (e) For purposes of acquiring consent from the 22 Wyoming legislature as required by subsection (b) of this 23 section, the Wyoming legislature during regular or special 2025STATE OF WYOMING25LSO-02934SF0105 1 session may approve or reject a notice of intent to sell or 2 transfer the real property to the federal government by 3 legislative order. When the legislature is not in regular 4 or special session, the management council shall have the 5 right to approve or reject a notice of intent to sell or 6 transfer the real property to the federal government by a 7 majority vote. The legislature or the management council 8 shall not approve a notice of intent to sell or transfer 9 real property to the federal government unless the federal 10 government would be acquiring the real property pursuant to 11 an enumerated constitutional power which may involve the 12 exercise of the federal power of eminent domain. The 13 legislature or the management council shall approve or 14 reject the notice of intent to sell or transfer the real 15 property under this subsection not later than ten (10) days 16 after receipt of the notice. If the legislature or 17 management council does not approve or reject notice of 18 intent to sell or transfer the real property within ten 19 (10) days after receipt of the notice then the notice for 20 the sale to proceed is deemed rejected. 21 2025STATE OF WYOMING25LSO-02935SF01051 The legislature and the management council 2 shall adopt all rules and policies necessary to implement 3 this act. 4 5 6 to sell or transfer real property to the federal government 7 entered into on and after July 1, 2025. 8 9.
