7-AN ACT relating to criminal procedure; requiring the
8-acceptance of reports of missing persons by law enforcement
9-as specified; providing exceptions; specifying duties for
10-law enforcement agencies and peace officers related to
11-missing persons; making conforming amendments; and
12-providing for an effective date.
13-Be It Enacted by the Legislature of the State of Wyoming:
14-Section 1. W.S. 7-2-109 is created to read:
15-7-2-109. Reporting of missing persons; report
16-acceptance; duties and responsibilities.
17-(a) Each Wyoming law enforcement agency shall accept,
18-without delay, any credible report of a missing person made
19-to the law enforcement agency, unless at least one (1) of
20-the following occurs:
21-(i) The law enforcement agency knows the
22-location of the person reported missing;
23-(ii) The law enforcement agency confirms the
24-safe status of the person reported missing;
25-(iii) The person reported missing is not a
26-resident of Wyoming, and the most recent verifiable
27-location of the person reported missing was not in Wyoming;
28-(iv) The law enforcement agency confirms that
29-another law enforcement agency already has, is accepting or
30-will accept, without delay, a missing person report for the

36-2(v) The person reporting the missing person is
37-unable to articulate reasonable knowledge of the missing
38-person or a legitimate reason for concern for the missing
39-person or the missing person's health, safety or welfare;
40-(vi) The law enforcement agency suspects, and
41-can articulate, that the person reported as missing
42-intended to lawfully flee;
43-(vii) The person reported missing is being
44-sought for reasons of harassment, stalking or retaliation;
45-(viii) Other articulable extenuating
46-circumstances exist, consistent with this section, that
47-would make acceptance of a report of the missing person
48-impractical, unreasonable or unsafe for the missing person,
49-and the law enforcement agency documents the extenuating
50-circumstances.
51-(b) The primary jurisdiction for reporting a missing
52-person shall be the law enforcement agency with
53-jurisdiction over the most recent verifiable location of
54-the missing person. If a verifiable last known location is
55-not determined, the primary jurisdiction shall be the law
56-enforcement agency with jurisdiction over the last known
57-residential address of the missing person. Nothing in this
58-subsection shall preclude or prohibit any other law
59-enforcement agency from accepting a report of a missing
60-person under this section.
61-(c) All missing person reports meeting the criteria
62-for reporting under this section shall be entered into the
63-relevant national, regional and state databases used by the
64-law enforcement agency for the sharing of missing person

71-entered by the dates and times required by law but not
72-later than eight (8) hours after the receipt of a report
73-and all required information for submission.
74-(d) If a missing person is not located within thirty
75-(30) days of being reported missing under this section, the
76-law enforcement agency that accepted the report under this
77-section shall ensure that a complete and accurate record of
78-information is compiled for the missing person, including a
79-photograph if available. The complete and accurate record
80-compiled shall be forwarded to the attorney general and the
81-division of criminal investigation for inclusion in the
82-clearinghouse database on missing persons established under
83-W.S. 9-1-624(a)(v).
84-(e) Upon receipt of a missing person report, the
85-primary jurisdiction shall request a photograph and
86-cellular telephone information of the missing person and,
87-without delay, notify appropriate law enforcement agencies
88-of the pertinent information and cellular telephone ping
89-results when appropriate.
90-(f) Upon receipt of a missing person report, the
91-primary jurisdiction shall evaluate the potential benefit
92-of notifying area news media and making an announcement via
93-social media channels that the law enforcement agency
94-routinely uses.
95-Section 2. W.S. 9-1-624(a)(v)(B) is amended to read:
96-9-1-624. Division of criminal investigation; uniform
97-procedures and forms for collecting and disseminating
98-identification data; missing persons repository; annual
99-crime statistics report; cold case database; agencies to
