7-AN ACT relating to public funds; authorizing specified
8-local governments to invest in equities as specified;
9-specifying requirements for investments in equities;
10-specifying applicability; authorizing actions; and
11-providing for effective dates.
12-Be It Enacted by the Legislature of the State of Wyoming:
13-Section 1. W.S. 9-4-831(a) by creating a new
14-paragraph (xxix) is amended to read:
15-9-4-831. Investment of public funds.
16-(a) The state treasurer, or treasurer of any
17-political subdivision, municipality or special district of
18-this state, and the various boards of trustees and boards
19-of directors of county hospitals, airports, fairs and other
20-duly constituted county boards and commissions, may invest
21-in:
22-(xxix) Equities, including stocks of
23-corporations. Investments made under this paragraph shall
24-comply with all provisions of investment policy statements
25-applicable to local government investing adopted by the
26-state loan and investment board. All risks associated with
27-the investment of equities under this paragraph shall be
28-assumed by the governmental entity making the investment. A
29-political subdivision shall establish an investment
30-advisory board to provide advice and expertise on
31-investments made under this paragraph. Investments made
32-under this paragraph shall not be subject to paragraph
33-(xxviii) of this subsection or W.S. 9-1-419. The state loan
34-and investment board shall adopt investment policy
35-statements for investments made by local governments and

42-shall include in the investment policy statements
43-requirements and conditions comparable to the requirements
44-and conditions specified in W.S. 9-4-715 and 9-4-716 for
45-the investment of public funds. Nothing in this paragraph
46-shall be construed to limit or alter the state treasurer's
47-authority to invest state funds in equities in accordance
48-with law.
49-Section 2. No political subdivision specified in W.S.
50-9-4-831(a)(intro) shall make investments authorized in W.S.
51-9-4-831(a)(xxix), as created by section 1 of this act,
52-before the state loan and investment board adopts
53-applicable investment policy statements in accordance with
54-this act.
55-Section 3. The state treasurer and the state loan and
56-investment board shall take all actions necessary to

64-section, this act is effective immediately upon completion

66-by Article 4, Section 8 of the Wyoming Constitution.
