AS 46.07.080(2) is amended to read: 3 (2) "village" means 4 (A) a second class city; 5 (B) a first class city with a population of less than 1,000; 6 (C) a home rule municipality with a population of less than 7 1,000; 8 (D) the Annette Island Reserve established by 25 U.S.C. 495 9 for the Metlakatla Indian Community; 10 (E) a community or a census-designated place with a 11 population between 25 and 1,500 [1,000] that is represented by 12 (i) a council organized under 25 U.S.C. 476 (sec. 16 of 13 the Indian Reorganization Act); 14 (ii) a traditional village council recognized by the 15 33-LS0556\B HB 114 -2- HB0114a New Text Underlined [DELETED TEXT BRACKETED] United States as eligible for federal aid to Indians; or 1 (iii) an incorporated nonprofit entity or Native village 2 council that the Department of Commerce, Community, and Economic 3 Development, with advice from the Department of Law, has 4 determined is eligible to receive and spend a community assistance 5 payment under AS 29.60.865, if the incorporated nonprofit entity or 6 Native village council agrees to act as a village governing body for the 7 purposes of this chapter and provides for the ongoing maintenance of a 8 project funded under this chapter. 9 * Sec. 2. AS 46.07.080 is amended by adding a new paragraph to read: 10 (3) "census-designated place" means a statistical geographic area that 11 represents a closely settled, unincorporated community that is locally recognized and 12 identified by name. 13
