AS 14.30 is amended by adding a new section to article 3 to read: 4 Sec. 14.30.145. Opioid overdose drugs. (a) Each school district shall ensure 5 that 6 (1) a person trained to administer an opioid overdose drug is on site 7 (A) when the main school building of each school in the school 8 district is open to students or staff, including periods when the school building 9 is open before and after school hours and during weekend activities; and 10 (B) during each school-sponsored event conducted on school 11 grounds; 12 (2) the main school building of each school in the school district has at 13 least two doses of an opioid overdose drug available on site; and 14 33-LS0705\R SCS CSHB 202(FIN) -2- HB0202C New Text Underlined [DELETED TEXT BRACKETED] (3) at least one dose of an opioid overdose drug is available during a 1 school-sponsored event conducted on school grounds. 2 (b) The Department of Health shall provide each school district with the 3 opioid overdose drug required under this section. The commissioner of health shall 4 develop and provide to each school district a short training video about how and when 5 to administer an opioid overdose drug. 6 (c) A school district, school, or individual is not liable for civil damages for an 7 injury to another individual resulting from a failure to possess or maintain an opioid 8 overdose drug under this section. 9 (d) In this section, 10 (1) "main school building" means the building on school grounds 11 where most of the students of the school are educated during regular school hours and 12 the principal, nurse, and other administrative staff of the school are located; 13 (2) "opioid overdose drug" has the meaning given in AS 17.20.085(e); 14 (3) "school district" means a borough school district, a city school 15 district, a regional educational attendance area, and a state boarding school; 16 (4) "school grounds" means a building, structure, athletic playing field, 17 playground, parking area, or land contained within the real property boundary line of a 18 school in a school district. 19 * Sec. 2. AS 17.20.085(e) is amended by adding a new paragraph to read: 20 (5) "school district" has the meaning given in AS 14.30.145(d). 21 * Sec. 3. AS 17.20.085 is amended by adding new subsections to read: 22 (f) Notwithstanding a provision or rule of law to the contrary, a school district, 23 if acting under a standing order or protocol under (a) or (c) of this section, may receive 24 a supply of opioid overdose drugs from the department and may possess opioid 25 overdose drugs for the purposes of AS 14.30.145. 26 (g) Notwithstanding a provision or rule of law to the contrary, a person, if 27 acting under a standing order or protocol under (a) or (c) of this section, may 28 administer an opioid overdose drug under AS 14.30.145 to a person at risk of 29 experiencing an opioid overdose. 30
