31+BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 3
5632 * Section 1. The uncodified law of the State of Alaska is amended by adding a new section 4
5733 to read: 5
5834 APPROVAL OF THE TRANSFER OF REAL PROPERTY TO THE CITY OF 6
5935 NENANA. (a) The Alaska Railroad Corporation is authorized to convey the corporation's 7
6036 interest in the surface estate of approximately 188 acres of rail land, described as follows, to 8
6137 the City of Nenana for fair market value, subject to valid existing rights: 9
6238 (1) an approximately 170-acre portion of Lot 2, U.S. Survey No. 1138, within 10
6339 Sections 14 and 23 of Township 4 South, Range 8 West, Fairbanks Meridian, according to the 11
6440 plat of survey officially filed April 10, 1998; 12
6541 (2) lots 1 and 2 of Block 1, Lots 23 and 24 of Block 2, Lots 4 and 5 of Block 13
66-11, and Lots 23 and 24 of Block 12, U.S. Survey No. 1127, within Section 14 of Township 4 14

7048 (3) an approximately 14-acre portion of the Railroad Reserve Lot, U.S. Survey 3
7149 No. 1127, within Sections 13 and 14 of Township 4 South, Range 8 West, Fairbanks 4
7250 Meridian, according to the plat of survey approved February 3, 1917. 5
7351 (b) The legislature recognizes that the real property described in (a) of this section 6
7452 includes portions of existing lots, which are not currently discrete and separate parcels, and 7
7553 that surveying and platting actions necessary to convey the real property described in (a) of 8
7654 this section will change the legal description of the real property. It is the intent of the 9
7755 legislature that the land transfer approved in this Act include any land described by a 10
7856 modification to the legal description of the real property described in (a) of this section. The 11
7957 Alaska Railroad Corporation and the City of Nenana shall make and execute an agreement to 12
8058 conduct any necessary surveying and platting actions. 13
8159 (c) In consideration for the conveyance authorized in (a) of this section, the Alaska 14
8260 Railroad Corporation may accept cash equivalent to the fair market value of the land being 15
8361 conveyed. 16
8462 (d) This section constitutes legislative approval under AS 42.40.285(1) for the Alaska 17
8563 Railroad Corporation to convey its entire interest in the land described in (a) of this section. 18
8664 * Sec. 2. This Act takes effect immediately under AS 01.10.070(c). 19
