FISCAL NOTE ANALYSIS This legislation amends penalties associated with controlled substances and removes statutory good time for those persons convicted under statute AS 11.71.010 – 11.71.030 or 11.71.040(a)(1). AS 11.41.110(a) is amended to include the condition that when someone who manufactures or delivers a controlled substance and the recipient dies as a result of ingesting the drug, the “dealer” can be charged with Murder 2 which is an unclassified felony. The impact of this change is anticipated to increase the daily inmate population starting in the third year of incarceration, however, is not expected to exceed the current available bed capacity within the prison system based on the current offender population. AS 33.20.010(a) is amended adding AS 11.71.010 thru AS 11.71.040 to the list of offenses ineligible for statutory good time (STG). These offenses are the suite of Misconduct of Controlled Substances (MICS) offenses. The impact of this change is anticipated to increase the daily inmate population; however, is not expected to exceed the current available bed capacity within the prison system based on the current offender population.
