2929 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 3
3030 * Section 1. AS 44.21.020 is amended to read: 4
3131 Sec. 44.21.020. Duties of department. The Department of Administration 5

3333 (1) make surveys and studies to improve administrative procedures, 7
3434 methods, and organization; 8
3535 (2) keep general accounts; 9
3636 (3) approve vouchers and disburse funds for all purposes; 10

5656 * Sec. 2. AS 44.21 is amended by adding a new section to read: 13
5757 Sec. 44.21.022. Address confidentiality program. (a) The address 14
5858 confidentiality program is established in the department to protect the confidentiality 15
5959 of the address of an individual enrolled in the program. 16
6060 (b) The department shall 17
6161 (1) establish and administer the program; 18
6262 (2) designate a post office box as a substitute mailing address for an 19
6363 individual enrolled in the program; 20
6464 (3) forward the mail of an individual enrolled in the program from the 21
6565 post office box designated under (2) of this subsection to the individual's residential 22
6666 street address, post office box, school address, or work address as specified on the 23
6767 individual's application for enrollment in the program; 24
6868 (4) maintain the confidentiality of the address of an individual enrolled 25
6969 in the program; and 26
70-(5) adopt regulations establishing a procedure for 27
71-(A) a qualified individual under (c) of this section to enroll in 28
72-or withdraw from the program; and 29
73-(B) determining whether an individual is eligible to participate 30

70+(5) adopt regulations establishing a procedure for a qualified individual 27
71+under (c) of this section to enroll in or withdraw from the program. 28
72+(c) The following individuals may enroll in the program: 29
73+(1) a victim of a crime involving domestic violence, stalking, or sexual 30

78-(c) An individual may enroll in the program if the individual is not required to 1
79-register as a sex offender or child kidnapper under AS 12.63 or a similar law of 2
80-another jurisdiction and is 3
81-(1) a victim of a crime involving domestic violence, stalking, or sexual 4
82-assault if 5
83-(A) a court has issued a protective order on behalf of the 6
84-victim; or 7
85-(B) the victim meets other standards set by the department; 8
86-(2) a guardian of a minor, if a court has issued a protective order on 9
87-behalf of the minor; 10
88-(3) a peace officer; 11
89-(4) a correctional officer; or 12
90-(5) a household member of an individual specified under (1) - (4) of 13
91-this subsection who is enrolled in the program. 14
92-(d) A state or municipal agency shall allow an individual enrolled in the 15
93-program to use the post office box designated by the department under (b)(2) of this 16
94-section as the individual's mailing address. 17
95-(e) The department shall remove an individual enrolled in the program under 18
96-(c)(1) or (2) of this section, or under (c)(5) of this section if the individual is a 19
97-household member of a person enrolled in the program under (c)(1) or (2) of this 20
98-section, from the program five years after the expiration of the protective order issued 21
99-on behalf of the victim or minor. The department shall remove an individual enrolled 22
100-in the program under (c)(3) or (4) of this section, or under (c)(5) of this section if the 23
101-individual is a household member of a person enrolled in the program under (c)(3) or 24
102-(4) of this section, from the program five years after the last day the individual or 25
103-individual's household member is employed as a peace officer or correctional officer. 26
104-The department shall remove an individual enrolled in the program if the individual is 27
105-convicted of a crime and required to register as a sex offender or child kidnapper 28
106-under AS 12.63 or a similar law of another jurisdiction. 29
107-(f) The department may not collect a registration fee from an individual 30
108-qualified under (c) of this section to enroll in the program. 31 33-LS0162\H

112-(g) The department shall disclose an individual's address to a peace officer in 1
113-response to a search warrant issued by a state or federal court. 2
114-(h) A person who discloses information that is confidential under this section 3
115-about an individual enrolled in the program under (c) of this section is guilty of a class 4
116-B misdemeanor if the person 5
117-(1) is authorized to access the address confidentiality program database 6
118-and recklessly discloses the information to the respondent of a protective order; 7
119-(2) is not authorized to access the address confidentiality program 8
120-database and knowingly discloses the information to the respondent of a protective 9
121-order; or 10
122-(3) accesses the address confidentiality program database without 11
123-authorization to access the database and recklessly discloses the information. 12
124-(i) In this section, 13
125-(1) "correctional officer" means a person 14
126-(A) appointed by the commissioner of corrections whose 15
127-primary duty under AS 33.30 is to provide custody, care, security, control, and 16
128-discipline of persons charged or convicted of offenses against the state or held 17
129-under authority of state law; 18
130-(B) employed in a correctional facility in this state whose 19
131-primary duty is to provide custody, care, security, control, and discipline of 20
132-persons charged or convicted of offenses or held under authority of law; or 21
133-(C) employed full time in a municipal correctional facility 22
134-whose primary duty is to provide custody, care, security, control, and 23
135-discipline of persons charged or convicted of offenses or held under authority 24
136-of law, and the correctional facility is located in a municipality that has 25
137-adopted AS 18.65.130 - 18.65.290 by ordinance under AS 18.65.285; 26
138-(2) "crime involving domestic violence" has the meaning given in 27
139-AS 18.66.990; 28
140-(3) "department" means the Department of Administration; 29
141-(4) "household member" means an adult or minor who lives in the 30
142-same residence as an individual enrolled in the program; 31 33-LS0162\H

114+(3) accesses the address confidentiality program database without 3
115+authorization to access the database and recklessly discloses the information. 4
116+(i) In this section, 5
117+(1) "correctional officer" means a person 6
