9-2 ENROLLED, An Act,
10-3 To make an appropriation of $389,327 from the
11-4 Education Trust Fund to Southern Preparatory Academy, formerly
12-5 Lyman Ward Military Academy, in Camp Hill, Alabama for the
13-6 support and maintenance of the educational program of the
14-7 institution, for the fiscal year ending September 30, 2023; to
15-8 provide that the appropriation is subject to certain
16-9 provisions of the Code of Alabama 1975; to require an
17-10 operations plan and an audited financial statement prior to
18-11 the release of any funds; and to require an end of year
19-12 report.
20-13 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
21-14 Section 1. There is hereby appropriated the sum of
22-15 $389,327 from the Education Trust Fund to Lyman Ward Military
23-16 Academy Southern Preparatory Academy, formerly Lyman Ward
24-17 Military Academy, in Camp Hill, Alabama for the support and
25-18 maintenance of the educational program of the institution, for
26-19 the fiscal year ending September 30, 2023.
27-20 Section 2. The above appropriation is made for the
28-21 support of public education in Alabama and for the support and
29-22 maintenance of the above program. The appropriation shall be
30-23 subject to the provisions, terms, conditions, and limitations
31-24 of the Budget and Financial Control Act, Code of Alabama 1975,
32-25 Sections 41-4-80 et seq.; the provisions of The Budget

34-1 Management Act of 1976, Code of Alabama 1975, Sections 41-19-1
35-2 et seq.; and any other provisions of this act.
36-3 Section 3. (a) Prior to the release of any funds
37-4 appropriated under this act the following reports shall be
38-5 submitted:
39-6 (1) An operations plan for the fiscal year 2023,
40-7 including goals and measurable performance indicators, shall
41-8 be submitted to and approved by the Director of Finance, as
42-9 provided for state agencies in Code of Alabama 1975, Section
43-10 41-19-10.
44-11 (2) An audited financial statement for all
45-12 operations during the fiscal year 2021.
46-13 (b) It is the intent that funds appropriated for
47-14 fiscal year 2023 shall be released by the Director of Finance
48-15 following receipt of the above reports.
49-16 (c) In addition, quarterly reports shall be made to
50-17 the Director of Finance relating actual expenditures and
51-18 accomplishments to planned expenditures and accomplishments.
52-19 An end of year performance report for the fiscal year 2023
53-20 shall be made to the Director of Finance stating the work
54-21 accomplished and the services provided and the costs of
55-22 accomplishing the work and providing the services, citing
56-23 meaningful measures of program effectiveness and costs, as is
57-24 required for state agencies in Code of Alabama 1975, Section
58-25 41-19-11.

60-1 (d) The Director of Finance shall forward a copy of
61-2 all required reports to the Legislative Council in a timely
62-3 manner.
63-4 Section 4. This act shall become effective October
64-5 1, 2022.
