2 ENROLLED, An Act,
3 To make an appropriation of $389,327 from the
4 Education Trust Fund to Southern Preparatory Academy, formerly
5 Lyman Ward Military Academy, in Camp Hill, Alabama for the
6 support and maintenance of the educational program of the
7 institution, for the fiscal year ending September 30, 2023; to
8 provide that the appropriation is subject to certain
9 provisions of the Code of Alabama 1975; to require an
10 operations plan and an audited financial statement prior to
11 the release of any funds; and to require an end of year
12 report.
13 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
14 Section 1. There is hereby appropriated the sum of
15 $389,327 from the Education Trust Fund to Lyman Ward Military
16 Academy Southern Preparatory Academy, formerly Lyman Ward
17 Military Academy, in Camp Hill, Alabama for the support and
18 maintenance of the educational program of the institution, for
19 the fiscal year ending September 30, 2023.
20 Section 2. The above appropriation is made for the
21 support of public education in Alabama and for the support and
22 maintenance of the above program. The appropriation shall be
23 subject to the provisions, terms, conditions, and limitations
24 of the Budget and Financial Control Act, Code of Alabama 1975,
25 Sections 41-4-80 et seq.; the provisions of The Budget

1 Management Act of 1976, Code of Alabama 1975, Sections 41-19-1
2 et seq.; and any other provisions of this act.
3 Section 3. (a) Prior to the release of any funds
4 appropriated under this act the following reports shall be
5 submitted:
6 (1) An operations plan for the fiscal year 2023,
7 including goals and measurable performance indicators, shall
8 be submitted to and approved by the Director of Finance, as
9 provided for state agencies in Code of Alabama 1975, Section
10 41-19-10.
11 (2) An audited financial statement for all
12 operations during the fiscal year 2021.
13 (b) It is the intent that funds appropriated for
14 fiscal year 2023 shall be released by the Director of Finance
15 following receipt of the above reports.
16 (c) In addition, quarterly reports shall be made to
17 the Director of Finance relating actual expenditures and
18 accomplishments to planned expenditures and accomplishments.
19 An end of year performance report for the fiscal year 2023
20 shall be made to the Director of Finance stating the work
21 accomplished and the services provided and the costs of
22 accomplishing the work and providing the services, citing
23 meaningful measures of program effectiveness and costs, as is
24 required for state agencies in Code of Alabama 1975, Section
25 41-19-11.

1 (d) The Director of Finance shall forward a copy of
2 all required reports to the Legislative Council in a timely
3 manner.
4 Section 4. This act shall become effective October
5 1, 2022.
