1 HB210 2 215907-2 3 By Representative Kitchens (N & P) 4 RFD: Local Legislation 5 First Read: 02-FEB-22 Page 0 HB210 1 2 ENROLLED, An Act, 3 Relating to Blount County; to provide for the Chair 4 of the Blount County Commission; to provide for the election 5 of the chair of the county commission on a countywide basis; 6 to provide for the term, duties, and compensation of the 7 chair; and to provide that the judge of probate shall no 8 longer serve as chair. 9 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: 10 Section 1. This act shall apply only in Blount 11 County. 12 Section 2. (a)(1) The position of Chair of the 13 Blount County Commission is established. The first chair shall 14 be elected on a countywide basis at the general election in 15 2024 following a primary election, if applicable, at the same 16 time and in the same manner as any primary election for 17 members of the county commission. The chair shall take office 18 at the same time members of the county commission take office 19 following their election. After the election and swearing in 20 of the first chair after the effective date of this act, the 21 judge of probate shall no longer serve as chair of the 22 commission. 23 (2) The chair shall serve a term of six years 24 commencing at the same time as the term of members of the 25 county commission provided by general law. Successor chairs Page 1 HB210 1 shall be elected in the same manner at the general election 2 every six years thereafter and shall commence his or her term 3 in the same manner. The chair shall serve until a successor is 4 elected and qualified. 5 (b) The Chair of the Blount County Commission shall 6 be a resident and qualified elector of the county for at least 7 one year prior to the date on which he or she would take 8 office. 9 (c) The salary of the Chair of the Blount County 10 Commission shall be the same as the base salary of the Blount 11 County Revenue Commissioner payable in the same manner as the 12 salary of the revenue commissioner. 13 (d) The chair shall preside over meetings of the 14 county commission and shall vote only in the case of a tie 15 vote of the district commissioners. 16 (e) In addition to the other duties and 17 responsibilities of the chair, the Chair of the Blount County 18 Commission shall do all of the following, as provided by law: 19 (1) Promote economic development in the county. 20 (2) Establish and enhance intergovernmental 21 partnerships. 22 (3) Serve as the representative of Blount County and 23 the Blount County Commission on any boards, committees, or 24 other organizations that require representation of the chair 25 of the county commission. Page 2 HB210 1 (4) Perform any other duties as determined by a 2 majority vote of the county commission. 3 (f) This act shall not be construed to affect the 4 salary of the judge of probate during the term for which he or 5 she is elected or appointed. 6 Section 3. All laws or parts of laws which conflict 7 with this act are repealed. 8 Section 4. This act shall become effective 9 immediately following its passage and approval by the 10 Governor, or its otherwise becoming law.
