10-2 ENROLLED, An Act,
11-3 Relating to Mobile County; abolishing the Office of
12-4 the Mobile County Treasurer upon the expiration of the current
13-5 term of office or upon a vacancy occurring in the office for
14-6 any reason; and providing for the county commission to perform
15-7 all acts, duties, and functions required by law to be
16-8 performed by the county treasurer.
17-9 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
18-10 Section 1. Upon the expiration of the current term
19-11 of the Office of the Mobile County Treasurer, or if a vacancy
20-12 occurs for any reason in the office prior to the expiration of
21-13 the current term of office, the Office of the Mobile County
22-14 Treasurer is abolished.
23-15 Section 2. Upon the abolition of the Office of
24-16 Mobile County Treasurer, the Mobile County Commission shall
25-17 perform all acts, duties, and functions required by law to be
26-18 performed by the treasurer. All records, assets, and property
27-19 held in the name of the county treasurer shall be transferred
28-20 to the Mobile County Commission and all merit employees of the
29-21 Mobile County Treasurer shall become employees of the Mobile
30-22 County Commission.
31-23 Section 3. All county depositories appointed as of
32-24 the date of abolition of the Office of Mobile County Treasurer
33-25 shall continue to serve as county depositories until such time

35-1 as the Mobile County Commission, by resolution, shall remove
36-2 any depository.
37-3 Section 4. It is the purpose of this act to preserve
38-4 revenue and promote public convenience in Mobile County by
39-5 abolishing the Office of Mobile County Treasurer and
40-6 consolidating the functions of the office into the existing
41-7 offices of the Mobile County Commission.
42-8 Section 5. Upon the abolition of the Office of
43-9 Mobile County Treasurer, the Mobile County Commission shall
44-10 commission an audit of the accounts of the Mobile County
45-11 Treasurer. The Mobile County Commission shall not assume any
46-12 liability for errors or omissions attributable to the acts or
47-13 omissions of the Mobile County Treasurer.
48-14 Section 6. Upon the abolishment of the Office of
49-15 Mobile County Treasurer, all laws or parts of laws which
50-16 conflict with this act are repealed.
51-17 Section 7. This act shall become effective
52-18 immediately following its passage and approval by the
53-19 Governor, or its otherwise becoming law.
