1 HB213 2 215431-2 3 By Representatives Drummond, Clarke, Gaston, Jones (S) and 4 Pringle (N & P) 5 RFD: Mobile County Legislation 6 First Read: 02-FEB-22 Page 0 HB213 1 2 ENROLLED, An Act, 3 Relating to Mobile County; abolishing the Office of 4 the Mobile County Treasurer upon the expiration of the current 5 term of office or upon a vacancy occurring in the office for 6 any reason; and providing for the county commission to perform 7 all acts, duties, and functions required by law to be 8 performed by the county treasurer. 9 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: 10 Section 1. Upon the expiration of the current term 11 of the Office of the Mobile County Treasurer, or if a vacancy 12 occurs for any reason in the office prior to the expiration of 13 the current term of office, the Office of the Mobile County 14 Treasurer is abolished. 15 Section 2. Upon the abolition of the Office of 16 Mobile County Treasurer, the Mobile County Commission shall 17 perform all acts, duties, and functions required by law to be 18 performed by the treasurer. All records, assets, and property 19 held in the name of the county treasurer shall be transferred 20 to the Mobile County Commission and all merit employees of the 21 Mobile County Treasurer shall become employees of the Mobile 22 County Commission. 23 Section 3. All county depositories appointed as of 24 the date of abolition of the Office of Mobile County Treasurer 25 shall continue to serve as county depositories until such time Page 1 HB213 1 as the Mobile County Commission, by resolution, shall remove 2 any depository. 3 Section 4. It is the purpose of this act to preserve 4 revenue and promote public convenience in Mobile County by 5 abolishing the Office of Mobile County Treasurer and 6 consolidating the functions of the office into the existing 7 offices of the Mobile County Commission. 8 Section 5. Upon the abolition of the Office of 9 Mobile County Treasurer, the Mobile County Commission shall 10 commission an audit of the accounts of the Mobile County 11 Treasurer. The Mobile County Commission shall not assume any 12 liability for errors or omissions attributable to the acts or 13 omissions of the Mobile County Treasurer. 14 Section 6. Upon the abolishment of the Office of 15 Mobile County Treasurer, all laws or parts of laws which 16 conflict with this act are repealed. 17 Section 7. This act shall become effective 18 immediately following its passage and approval by the 19 Governor, or its otherwise becoming law.
