1 HB381 2 216459-1 3 By Representative Standridge (N & P) 4 RFD: Local Legislation 5 First Read: 17-FEB-22 Page 0 1 216459-1:n:01/19/2022:LK/tgw LSA2022-213 2 3 4 5 6 7 8 9 A BILL 10 TO BE ENTITLED 11 AN ACT 12 13 Relating to Blount County; to amend Section 14 45-5-230, Code of Alabama 1975, providing for the compensation 15 of the sheriff, to further provide for the salary of the 16 sheriff; and to provide for the qualifications to hold the 17 office of sheriff. 18 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: 19 Section 1. Section 45-5-230, Code of Alabama 1975, 20 is amended to read as follows: 21 "ยง45-5-230. 22 "(a) Commencing July 1, 2000, the Sheriff of Blount 23 County shall be entitled to an additional expense allowance in 24 the amount of twelve thousand dollars ($12,000) per annum, 25 which shall be in addition to all other expense allowances, 26 compensation, or salary provided by law. This expense Page 1 1 allowance shall be payable in equal monthly installments from 2 the general fund of the county. 3 "(b)(a) Beginning with the expiration of the term of 4 the incumbent sheriff in office on the effective date of this 5 amendatory act, the annual salary for the Sheriff of Blount 6 County shall be fifty thousand dollars ($50,000) per annum 7 equal to 90 percent of the annual base salary of the judge of 8 probate of the county, payable in equal monthly installments 9 from the general fund of the county and at that time, 10 subsection (a) shall become null and void. 11 "(c) The expense allowance and (b) The salary 12 provided in this section shall be inoperative if the sheriff 13 receives an additional expense allowance or salary increase 14 pursuant to general law during the current term of office or 15 effective upon the beginning of the next term of office which 16 is equal to or greater than the amount provided by this 17 section." 18 Section 2. (a) Any individual appointed to serve as 19 Sheriff of Blount County shall meet all of the following 20 minimum qualifications, in addition to any other 21 qualifications required by law; and, effective on the first 22 day of the qualifying period for the 2026 election for the 23 office of sheriff, any individual qualifying for election to 24 the office of sheriff shall meet all of the following 25 qualifications, in addition to any other qualifications 26 required by law: Page 2 1 (1) The individual is a citizen of the United 2 States. 3 (2) The individual has been a resident of the county 4 for at least one year immediately prior to the date of 5 qualification or appointment. 6 (3) The individual has the qualifications of an 7 elector pursuant to state and federal law, and the individual 8 has been registered to vote in the county at least one year 9 immediately prior to the date of qualification or appointment. 10 (4) The individual has been awarded a high school 11 diploma or GED equivalent. 12 (5) The individual is 25 years of age or older prior 13 to qualifying or being appointed. 14 (6) The individual has three or more cumulative 15 years of prior full-time experience as a law enforcement 16 officer having the power of arrest. 17 (7) The individual has never been convicted of a 18 felony. 19 (b) This section shall not apply to or affect a 20 supernumerary sheriff. 21 Section 3. This act shall become effective on 22 immediately following its passage and approval by the 23 Governor, or its otherwise becoming law. Page 3
