1 HB381 2 216459-2 3 By Representative Standridge (N & P) 4 RFD: Local Legislation 5 First Read: 17-FEB-22 Page 0 HB381 1 2 ENROLLED, An Act, 3 Relating to Blount County; to amend Section 4 45-5-230, Code of Alabama 1975, providing for the compensation 5 of the sheriff, to further provide for the salary of the 6 sheriff; and to provide for the qualifications to hold the 7 office of sheriff. 8 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: 9 Section 1. Section 45-5-230, Code of Alabama 1975, 10 is amended to read as follows: 11 "ยง45-5-230. 12 "(a) Commencing July 1, 2000, the Sheriff of Blount 13 County shall be entitled to an additional expense allowance in 14 the amount of twelve thousand dollars ($12,000) per annum, 15 which shall be in addition to all other expense allowances, 16 compensation, or salary provided by law. This expense 17 allowance shall be payable in equal monthly installments from 18 the general fund of the county. 19 "(b)(a) Beginning with the expiration of the term of 20 the incumbent sheriff in office on the effective date of this 21 amendatory act, the annual salary for the Sheriff of Blount 22 County shall be fifty thousand dollars ($50,000) per annum 23 equal to 90 percent of the annual base salary of the judge of 24 probate of the county, payable in equal monthly installments Page 1 HB381 1 from the general fund of the county and at that time, 2 subsection (a) shall become null and void. 3 "(c) The expense allowance and (b) The salary 4 provided in this section shall be inoperative if the sheriff 5 receives an additional expense allowance or salary increase 6 pursuant to general law during the current term of office or 7 effective upon the beginning of the next term of office which 8 is equal to or greater than the amount provided by this 9 section." 10 Section 2. (a) Any individual appointed to serve as 11 Sheriff of Blount County shall meet all of the following 12 minimum qualifications, in addition to any other 13 qualifications required by law; and, effective on the first 14 day of the qualifying period for the 2026 election for the 15 office of sheriff, any individual qualifying for election to 16 the office of sheriff shall meet all of the following 17 qualifications, in addition to any other qualifications 18 required by law: 19 (1) The individual is a citizen of the United 20 States. 21 (2) The individual has been a resident of the county 22 for at least one year immediately prior to the date of 23 qualification or appointment. 24 (3) The individual has the qualifications of an 25 elector pursuant to state and federal law, and the individual Page 2 HB381 1 has been registered to vote in the county at least one year 2 immediately prior to the date of qualification or appointment. 3 (4) The individual has been awarded a high school 4 diploma or GED equivalent. 5 (5) The individual is 25 years of age or older prior 6 to qualifying or being appointed. 7 (6) The individual has three or more cumulative 8 years of prior full-time experience as a law enforcement 9 officer having the power of arrest. 10 (7) The individual has never been convicted of a 11 felony. 12 (b) This section shall not apply to or affect a 13 supernumerary sheriff. 14 Section 3. This act shall become effective on 15 immediately following its passage and approval by the 16 Governor, or its otherwise becoming law.
