9-2 ENROLLED, An Act,
10-3 Relating to Blount County; to amend Section
11-4 45-5-230, Code of Alabama 1975, providing for the compensation
12-5 of the sheriff, to further provide for the salary of the
13-6 sheriff; and to provide for the qualifications to hold the
14-7 office of sheriff.
15-8 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
16-9 Section 1. Section 45-5-230, Code of Alabama 1975,
17-10 is amended to read as follows:
18-11 "§45-5-230.
19-12 "(a) Commencing July 1, 2000, the Sheriff of Blount
20-13 County shall be entitled to an additional expense allowance in
21-14 the amount of twelve thousand dollars ($12,000) per annum,
22-15 which shall be in addition to all other expense allowances,
23-16 compensation, or salary provided by law. This expense
24-17 allowance shall be payable in equal monthly installments from
25-18 the general fund of the county.
26-19 "(b)(a) Beginning with the expiration of the term of
27-20 the incumbent sheriff in office on the effective date of this
28-21 amendatory act, the annual salary for the Sheriff of Blount
29-22 County shall be fifty thousand dollars ($50,000) per annum
30-23 equal to 90 percent of the annual base salary of the judge of
31-24 probate of the county, payable in equal monthly installments

33-1 from the general fund of the county and at that time,
34-2 subsection (a) shall become null and void.
35-3 "(c) The expense allowance and (b) The salary
36-4 provided in this section shall be inoperative if the sheriff
37-5 receives an additional expense allowance or salary increase
38-6 pursuant to general law during the current term of office or
39-7 effective upon the beginning of the next term of office which
40-8 is equal to or greater than the amount provided by this
41-9 section."
42-10 Section 2. (a) Any individual appointed to serve as
43-11 Sheriff of Blount County shall meet all of the following
44-12 minimum qualifications, in addition to any other
45-13 qualifications required by law; and, effective on the first
46-14 day of the qualifying period for the 2026 election for the
47-15 office of sheriff, any individual qualifying for election to
48-16 the office of sheriff shall meet all of the following
49-17 qualifications, in addition to any other qualifications
50-18 required by law:
51-19 (1) The individual is a citizen of the United
52-20 States.
53-21 (2) The individual has been a resident of the county
54-22 for at least one year immediately prior to the date of
55-23 qualification or appointment.
56-24 (3) The individual has the qualifications of an
57-25 elector pursuant to state and federal law, and the individual

59-1 has been registered to vote in the county at least one year
60-2 immediately prior to the date of qualification or appointment.
61-3 (4) The individual has been awarded a high school
62-4 diploma or GED equivalent.
63-5 (5) The individual is 25 years of age or older prior
64-6 to qualifying or being appointed.
65-7 (6) The individual has three or more cumulative
66-8 years of prior full-time experience as a law enforcement
67-9 officer having the power of arrest.
68-10 (7) The individual has never been convicted of a
69-11 felony.
70-12 (b) This section shall not apply to or affect a
71-13 supernumerary sheriff.
72-14 Section 3. This act shall become effective on
73-15 immediately following its passage and approval by the
74-16 Governor, or its otherwise becoming law.
