9-2 ENROLLED, An Act,
10-3 Relating to any Class 5 municipality organized under
11-4 the provisions of Act 71, 1977 Regular Session (Acts 1977, p.
12-5 78), as amended, which provides for a council manager form of
13-6 government in certain municipalities having certain
14-7 populations; to provide further for the compensation of the
15-8 council members and mayor; and to repeal Act 2009-737 of the
16-9 2009 Regular Session (Acts 2009, p. 2201).
17-10 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
18-11 Section 1. This act shall apply only in a Class 5
19-12 municipality organized under the provisions of Act 71, 1977
20-13 Regular Session (Acts 1977, p. 78), as amended.
21-14 Section 2. (a) This section shall become effective
22-15 beginning the next term of office of the city council
23-16 following the effective date of this act.
24-17 (b) The members of the city council shall receive an
25-18 annual salary of twenty-eight thousand dollars ($28,000) per
26-19 year, in lieu of any and all salary, expense allowance, or
27-20 other compensation now provided by law.
28-21 (c)(1) The city council, by majority recorded roll
29-22 call vote of the entire elected members of the council
30-23 conducted not later than six months prior to the next
31-24 qualifying date for election to the council, may grant to each
32-25 member of the council an additional expense allowance, payable

34-1 in equal monthly installments from the general fund of the
35-2 municipality.
36-3 (2) Any expense allowance granted to the members of
37-4 the city council shall become salary effective upon the next
38-5 term of office following the approval of the expense
39-6 allowance.
40-7 (d) Notwithstanding any provision of this section or
41-8 any other provision of the law to the contrary, the total
42-9 annual compensation of any member of the city council may not
43-10 exceed the total annual compensation of the mayor.
44-11 Section 3. Effective beginning the next term of
45-12 office of the mayor following the effective date of this act,
46-13 the mayor shall receive an annual salary of thirty-five
47-14 thousand ($35,000) dollars, in lieu of any and all salary,
48-15 expense allowance, or other compensation now provided by law.
49-16 Section 4. Act 2009-737 of the 2009 Regular Session
50-17 (Acts 2009, p. 2201), providing for the compensation of the
51-18 mayor and members of the city council of Class 5
52-19 municipalities incorporated under the provisions of Act 71,
53-20 1977 Regular Session (Acts 1977, p. 78), is repealed.
54-21 Section 5. This act shall become effective
55-22 immediately following its passage and approval by the
56-23 Governor, or its otherwise becoming law.
