2 ENROLLED, An Act,
3	Relating to any Class 5 municipality organized under
4 the provisions of Act 71, 1977 Regular Session (Acts 1977, p.
5 78), as amended, which provides for a council manager form of
6 government in certain municipalities having certain
7 populations; to provide further for the compensation of the
8 council members and mayor; and to repeal Act 2009-737 of the
9 2009 Regular Session (Acts 2009, p. 2201).
10 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
11	Section 1. This act shall apply only in a Class 5
12 municipality organized under the provisions of Act 71, 1977
13 Regular Session (Acts 1977, p. 78), as amended.
14	Section 2. (a) This section shall become effective
15 beginning the next term of office of the city council
16 following the effective date of this act.
17	(b) The members of the city council shall receive an
18 annual salary of twenty-eight thousand dollars ($28,000) per
19 year, in lieu of any and all salary, expense allowance, or
20 other compensation now provided by law.
21	(c)(1) The city council, by majority recorded roll
22 call vote of the entire elected members of the council
23 conducted not later than six months prior to the next
24 qualifying date for election to the council, may grant to each
25 member of the council an additional expense allowance, payable

1 in equal monthly installments from the general fund of the
2 municipality.
3	(2) Any expense allowance granted to the members of
4 the city council shall become salary effective upon the next
5 term of office following the approval of the expense
6 allowance.
7	(d) Notwithstanding any provision of this section or
8 any other provision of the law to the contrary, the total
9 annual compensation of any member of the city council may not
10 exceed the total annual compensation of the mayor.
11	Section 3. Effective beginning the next term of
12 office of the mayor following the effective date of this act,
13 the mayor shall receive an annual salary of thirty-five
14 thousand ($35,000) dollars, in lieu of any and all salary,
15 expense allowance, or other compensation now provided by law.
16	Section 4. Act 2009-737 of the 2009 Regular Session
17 (Acts 2009, p. 2201), providing for the compensation of the
18 mayor and members of the city council of Class 5
19 municipalities incorporated under the provisions of Act 71,
20 1977 Regular Session (Acts 1977, p. 78), is repealed.
21	Section 5. This act shall become effective
22 immediately following its passage and approval by the
23 Governor, or its otherwise becoming law.
