8 SYNOPSIS:         This bill would propose an amendment to the
9	Constitution of Alabama of 1901, relating to Butler
10	County, to prohibit any municipality lying within
11	the county from forming a separate city school
12	system without the prior approval of a majority of
13	the qualified electors of Butler County voting at a
14	referendum election.

17	TO BE ENTITLED
18	AN ACT
19 
20	To propose and amendment to the Constitution of
21 Alabama of 1901, relating to Butler County, to prohibit any
22 municipality lying within the county from establishing a
23 separate city school system without the prior approval of a
24 majority of the qualified electors of the county voting at
25 a referendum election.
26 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
Page 1 1	Section 1. The following amendment to the
2 Constitution of Alabama of 1901, is proposed and shall become
3 valid as a part of the Constitution when all requirements of
4 this act are fulfilled:
5	PROPOSED AMENDMENT
6	In Butler County, no municipality lying within the
7 county may establish a separate city school system after
8 January 1, 2022, without the prior approval of a majority of
9 the qualified electors of the county voting at
10 a referendum election held during a regularly scheduled
11 statewide general election in the county.
12	Upon ratification of this constitutional amendment
13 and contingent upon the ratification of the Constitution of
14 Alabama of 2022, the Code Commissioner shall number and place
15 this amendment as appropriate in the constitution based upon a
16 logical sequence and the particular subject or topic of the
17 amendment. In this amendment, the Code Commissioner may change
18 capitalization, spelling, and punctuation for the purpose of
19 style and uniformity; correct manifest grammatical, clerical,
20 and typographical errors; and correct incorrect
21 cross-references. When publishing the Constitution of Alabama
22 of 2022, the Code Commissioner may omit this instructional
23 paragraph.
24	Section 2. An election upon the proposed amendment
25 shall be held in accordance with Section 284.01 of the
26 Constitution of Alabama of 1901, now appearing as Section
27 284.01 of the Official Recompilation of the Constitution of
Page 2 1 Alabama of 1901, as amended, and the election laws of this
2 state.
3	Section 3. The appropriate election official shall
4 assign a ballot number for the proposed constitutional
5 amendment on the election ballot and shall set forth the
6 following description of the substance or subject matter of
7 the proposed constitutional amendment:
8	"Relating to Butler County, proposing an amendment
9 to the Constitution of Alabama of 1901, to prohibit any
10 municipality lying within the county from forming a separate
11 city school system after January 1, 2022, without the prior
12 approval of a majority of the qualified electors of Butler
13 County voting at a referendum election.
14	"Proposed by Act _________"
15	This description shall be followed by the following
16 language:
17	"Yes ( ) No ( )."
