9-2 ENROLLED, An Act,
10-3 To propose and amendment to the Constitution of
11-4 Alabama of 1901, relating to Butler County, to prohibit any
12-5 municipality lying within the county from establishing a
13-6 separate city school system without the prior approval of a
14-7 majority of the qualified electors of the county voting at
15-8 a referendum election.
16-9 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
17-10 Section 1. The following amendment to the
18-11 Constitution of Alabama of 1901, is proposed and shall become
19-12 valid as a part of the Constitution when all requirements of
20-13 this act are fulfilled:
21-14 PROPOSED AMENDMENT
22-15 In Butler County, no municipality lying within the
23-16 county may establish a separate city school system after
24-17 January 1, 2022, without the prior approval of a majority of
25-18 the qualified electors of the county voting at
26-19 a referendum election held during a regularly scheduled
27-20 statewide general election in the county.
28-21 Upon ratification of this constitutional amendment
29-22 and contingent upon the ratification of the Constitution of
30-23 Alabama of 2022, the Code Commissioner shall number and place
31-24 this amendment as appropriate in the constitution based upon a
32-25 logical sequence and the particular subject or topic of the

34-1 amendment. In this amendment, the Code Commissioner may change
35-2 capitalization, spelling, and punctuation for the purpose of
36-3 style and uniformity; correct manifest grammatical, clerical,
37-4 and typographical errors; and correct incorrect
38-5 cross-references. When publishing the Constitution of Alabama
39-6 of 2022, the Code Commissioner may omit this instructional
40-7 paragraph.
41-8 Section 2. An election upon the proposed amendment
42-9 shall be held in accordance with Section 284.01 of the
43-10 Constitution of Alabama of 1901, now appearing as Section
44-11 284.01 of the Official Recompilation of the Constitution of
45-12 Alabama of 1901, as amended, and the election laws of this
46-13 state.
47-14 Section 3. The appropriate election official shall
48-15 assign a ballot number for the proposed constitutional
49-16 amendment on the election ballot and shall set forth the
50-17 following description of the substance or subject matter of
51-18 the proposed constitutional amendment:
52-19 "Relating to Butler County, proposing an amendment
53-20 to the Constitution of Alabama of 1901, to prohibit any
54-21 municipality lying within the county from forming a separate
55-22 city school system after January 1, 2022, without the prior
56-23 approval of a majority of the qualified electors of Butler
57-24 County voting at a referendum election.
58-25 "Proposed by Act _________"
