1414 8 SYNOPSIS: Under existing law, any income generated
1515 9 from Forever Wild Land Trust property is required

3333 Page 1 1 To propose a local constitutional amendment relating
3434 2 to Coosa County to make a certain percentage of Forever Wild
3535 3 Land Trust property available on a marketplace for carbon
3636 4 credits; and to require any income received to be credited to
3737 5 the General Fund of Coosa County.
3838 6 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3939 7 Section 1. The following amendment to the
4040 8 Constitution of Alabama of 1901, is proposed and shall become
4141 9 valid as a part of the Constitution when all requirements of
4242 10 this act are fulfilled:
4343 11 PROPOSED AMENDMENT
4444 12 (a) This amendment will only apply to Coosa County.
4545 13 (b) No later than January 1, 2025, and continually
4646 14 thereafter, the Department of Conservation and Natural
4747 15 Resources shall ensure that at least 50 percent of all Forever
4848 16 Wild Land Trust property located in Coosa County is available
4949 17 on a marketplace for carbon credits or other similar forestry
5050 18 carbon offsets.
5151 19 (c) Any income received from carbon credits or other
5252 20 similar forestry carbon offsets generated from the management
5353 21 of Forever Wild forest resources in Coosa County shall be
5454 22 credited to the General Fund of Coosa County.
5555 23 Upon ratification of this constitutional amendment
5656 24 and contingent upon the ratification of the Constitution of
5757 25 Alabama of 2022, the Code Commissioner shall number and place
5858 26 this amendment as appropriate in the constitution based upon a
5959 27 logical sequence and the particular subject or topic of the
6060 Page 2 1 amendment. In this amendment, the Code Commissioner may change
6161 2 capitalization, spelling, and punctuation for the purpose of
6262 3 style and uniformity; correct manifest grammatical, clerical,
6363 4 and typographical errors; and correct incorrect
6464 5 cross-references. When publishing the Constitution of Alabama
6565 6 of 2022, as amended, the Code Commissioner may omit this
6666 7 instructional paragraph.
6767 8 Section 2. An election upon the proposed amendment
6868 9 shall be held in accordance with Section 284.01 of the
6969 10 Constitution of Alabama of 1901, now appearing as Section
7070 11 284.01 of the Official Recompilation of the Constitution of
7171 12 Alabama of 1901, as amended, and the election laws of this
7272 13 state.
7373 14 Section 3. The appropriate election official shall
7474 15 assign a ballot number for the proposed constitutional
7575 16 amendment on the election ballot and shall set forth the
7676 17 following description of the substance or subject matter of
7777 18 the proposed constitutional amendment:
7878 19 "Relating to Coosa County, proposing an amendment to
7979 20 the Constitution of Alabama of 1901, to provide that the
8080 21 Department of Conservation and Natural Resources shall market
8181 22 carbon credits for at least 50 percent of all Forever Wild
8282 23 Land Trust property located in Coosa County and any income
8383 24 from carbon credits generated from the management of Forever
8484 25 Wild forest resources located in Coosa County would be
8585 26 credited to the General Fund of Coosa County.
