14	14	8 SYNOPSIS: Under existing law, any income generated
15	15	9 from Forever Wild Land Trust property is required
16	16	10 to be treated as interest of the Alabama Trust Fund
17	17	11 and credited to the State General Fund.
18	18	12 This bill would propose a local
19	19	13 constitutional amendment relating to Coosa County
20	20	14 to require the Department of Conservation and
21	21	15 Natural Resources to market carbon credits for at
22	22	16 least 50 percent of all Forever Wild Land Trust
23	23	17 property located in Coosa County and to provide
24	24	18 that any income from carbon credits generated from
25	25	19 the management of Forever Wild forest resources
26	26	20 located in Coosa County would be credited to the
27	27	21 General Fund of Coosa County.

33	33	Page 1 1 To propose a local constitutional amendment relating
34	34	2 to Coosa County to make a certain percentage of Forever Wild
35	35	3 Land Trust property available on a marketplace for carbon
36	36	4 credits; and to require any income received to be credited to
37	37	5 the General Fund of Coosa County.
38	38	6 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
39	39	7 Section 1. The following amendment to the
40	40	8 Constitution of Alabama of 1901, is proposed and shall become
41	41	9 valid as a part of the Constitution when all requirements of
42	42	10 this act are fulfilled:
43	43	11 PROPOSED AMENDMENT
44	44	12 (a) This amendment will only apply to Coosa County.
45	45	13 (b) No later than January 1, 2025, and continually
46	46	14 thereafter, the Department of Conservation and Natural
47	47	15 Resources shall ensure that at least 50 percent of all Forever
48	48	16 Wild Land Trust property located in Coosa County is available
49	49	17 on a marketplace for carbon credits or other similar forestry
50	50	18 carbon offsets.
51	51	19 (c) Any income received from carbon credits or other
52	52	20 similar forestry carbon offsets generated from the management
53	53	21 of Forever Wild forest resources in Coosa County shall be
54	54	22 credited to the General Fund of Coosa County.
55	55	23 Upon ratification of this constitutional amendment
56	56	24 and contingent upon the ratification of the Constitution of
57	57	25 Alabama of 2022, the Code Commissioner shall number and place
58	58	26 this amendment as appropriate in the constitution based upon a
59	59	27 logical sequence and the particular subject or topic of the
60	60	Page 2 1 amendment. In this amendment, the Code Commissioner may change
61	61	2 capitalization, spelling, and punctuation for the purpose of
62	62	3 style and uniformity; correct manifest grammatical, clerical,
63	63	4 and typographical errors; and correct incorrect
64	64	5 cross-references. When publishing the Constitution of Alabama
65	65	6 of 2022, as amended, the Code Commissioner may omit this
66	66	7 instructional paragraph.
67	67	8 Section 2. An election upon the proposed amendment
68	68	9 shall be held in accordance with Section 284.01 of the
69	69	10 Constitution of Alabama of 1901, now appearing as Section
70	70	11 284.01 of the Official Recompilation of the Constitution of
71	71	12 Alabama of 1901, as amended, and the election laws of this
72	72	13 state.
73	73	14 Section 3. The appropriate election official shall
74	74	15 assign a ballot number for the proposed constitutional
75	75	16 amendment on the election ballot and shall set forth the
76	76	17 following description of the substance or subject matter of
77	77	18 the proposed constitutional amendment:
78	78	19 "Relating to Coosa County, proposing an amendment to
79	79	20 the Constitution of Alabama of 1901, to provide that the
80	80	21 Department of Conservation and Natural Resources shall market
81	81	22 carbon credits for at least 50 percent of all Forever Wild
82	82	23 Land Trust property located in Coosa County and any income
83	83	24 from carbon credits generated from the management of Forever
84	84	25 Wild forest resources located in Coosa County would be
85	85	26 credited to the General Fund of Coosa County.
