8 SYNOPSIS:         Under existing law, any income generated
9	from Forever Wild Land Trust property is required
10	to be treated as interest of the Alabama Trust Fund
11	and credited to the State General Fund.
12	This bill would propose a local
13	constitutional amendment relating to Coosa County
14	to require the Department of Conservation and
15	Natural Resources to market carbon credits for at
16	least 50 percent of all Forever Wild Land Trust
17	property located in Coosa County and to provide
18	that any income from carbon credits generated from
19	the management of Forever Wild forest resources
20	located in Coosa County would be credited to the
21	General Fund of Coosa County.

Page 1 1	To propose a local constitutional amendment relating
2 to Coosa County to make a certain percentage of Forever Wild
3 Land Trust property available on a marketplace for carbon
4 credits; and to require any income received to be credited to
5 the General Fund of Coosa County.
6 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
7	Section 1. The following amendment to the
8 Constitution of Alabama of 1901, is proposed and shall become
9 valid as a part of the Constitution when all requirements of
10 this act are fulfilled:
11	PROPOSED AMENDMENT
12	(a) This amendment will only apply to Coosa County. 
13	(b) No later than January 1, 2025, and continually
14 thereafter, the Department of Conservation and Natural
15 Resources shall ensure that at least 50 percent of all Forever
16 Wild Land Trust property located in Coosa County is available
17 on a marketplace for carbon credits or other similar forestry
18 carbon offsets.
19	(c) Any income received from carbon credits or other
20 similar forestry carbon offsets generated from the management
21 of Forever Wild forest resources in Coosa County shall be
22 credited to the General Fund of Coosa County.
23	Upon ratification of this constitutional amendment
24 and contingent upon the ratification of the Constitution of
25 Alabama of 2022, the Code Commissioner shall number and place
26 this amendment as appropriate in the constitution based upon a
27 logical sequence and the particular subject or topic of the
Page 2 1 amendment. In this amendment, the Code Commissioner may change
2 capitalization, spelling, and punctuation for the purpose of
3 style and uniformity; correct manifest grammatical, clerical,
4 and typographical errors; and correct incorrect
5 cross-references. When publishing the Constitution of Alabama
6 of 2022, as amended, the Code Commissioner may omit this
7 instructional paragraph.
8	Section 2. An election upon the proposed amendment
9 shall be held in accordance with Section 284.01 of the
10 Constitution of Alabama of 1901, now appearing as Section
11 284.01 of the Official Recompilation of the Constitution of
12 Alabama of 1901, as amended, and the election laws of this
13 state.
14	Section 3. The appropriate election official shall
15 assign a ballot number for the proposed constitutional
16 amendment on the election ballot and shall set forth the
17 following description of the substance or subject matter of
18 the proposed constitutional amendment:
19	"Relating to Coosa County, proposing an amendment to
20 the Constitution of Alabama of 1901, to provide that the
21 Department of Conservation and Natural Resources shall market
22 carbon credits for at least 50 percent of all Forever Wild
23 Land Trust property located in Coosa County and any income
24 from carbon credits generated from the management of Forever
25 Wild forest resources located in Coosa County would be
26 credited to the General Fund of Coosa County.
