1414 8 SYNOPSIS: Under existing law, with certain exceptions,
1515 9 low-speed vehicles, including golf carts, may not
1616 10 operate on the public roads of this state.
1717 11 This bill would propose an amendment to the
1818 12 Constitution of Alabama of 1901, to authorize the
1919 13 Shelby County Commission and municipalities within
2020 14 the county to authorize and regulate the use of
2121 15 low-speed vehicles, including many golf carts, on
2222 16 certain public roads.

2828 22 Relating to Shelby County; to propose an amendment
2929 23 to the Constitution of Alabama of 1901, to authorize the
3030 24 Shelby County Commission and municipalities within the county
3131 25 to authorize the use of low-speed vehicles on certain public
3232 26 roads.
3333 27 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3434 Page 1 1 Section 1. The following amendment to the
3535 2 Constitution of Alabama of 1901, is proposed and shall become
3636 3 valid as a part of the Constitution when all requirements of
3737 4 this act are fulfilled:
3838 5 PROPOSED AMENDMENT
3939 6 (a) As used in this amendment, the term "low-speed
4040 7 vehicle" means a four-wheeled motor vehicle with a top speed
4141 8 of not greater than 25 miles per hour, which has a
4242 9 gross vehicle weight rating of less than 3,000 pounds, and is
4343 10 certified as complying with the applicable federal safety
4444 11 standards, including 49 C.F.R. ยง 571.500, as amended.
4545 12 (b)(1) The governing body of a municipality in
4646 13 Shelby County, by ordinance, may authorize and regulate the
4747 14 operation of low-speed vehicles on certain public roads within
4848 15 the corporate limits of the municipality, as determined by the
4949 16 governing body of the municipality.
5050 17 (2) The Shelby County Commission, by resolution, may
5151 18 authorize and regulate the operation of low-speed vehicles on
5252 19 certain public roads in the unincorporated portions of the
5353 20 county, as determined by the county commission.
5454 21 Section 2. An election upon the proposed amendment
5555 22 shall be held in accordance with Section 284.01 of the
5656 23 Constitution of Alabama of 1901, now appearing as Section
5757 24 284.01 of the Official Recompilation of the Constitution of
5858 25 Alabama of 1901, as amended, and the election laws of this
5959 26 state.

6161 2 assign a ballot number for the proposed constitutional
6262 3 amendment on the election ballot and shall set forth the
6363 4 following description of the substance or subject matter of
6464 5 the proposed constitutional amendment:
6565 6 "Relating to Shelby County, proposing an amendment
6666 7 to the Constitution of Alabama of 1901, to authorize the
6767 8 Shelby County Commission and municipalities within the county
6868 9 to authorize and regulate the use of low-speed vehicles,
6969 10 including certain golf carts, on certain public roads.
