14	14	8 SYNOPSIS: Under existing law, with certain exceptions,
15	15	9 low-speed vehicles, including golf carts, may not
16	16	10 operate on the public roads of this state.
17	17	11 This bill would propose an amendment to the
18	18	12 Constitution of Alabama of 1901, to authorize the
19	19	13 Shelby County Commission and municipalities within
20	20	14 the county to authorize and regulate the use of
21	21	15 low-speed vehicles, including many golf carts, on
22	22	16 certain public roads.

26	26	20 AN ACT

28	28	22 Relating to Shelby County; to propose an amendment
29	29	23 to the Constitution of Alabama of 1901, to authorize the
30	30	24 Shelby County Commission and municipalities within the county
31	31	25 to authorize the use of low-speed vehicles on certain public
32	32	26 roads.
33	33	27 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
34	34	Page 1 1 Section 1. The following amendment to the
35	35	2 Constitution of Alabama of 1901, is proposed and shall become
36	36	3 valid as a part of the Constitution when all requirements of
37	37	4 this act are fulfilled:
38	38	5 PROPOSED AMENDMENT
39	39	6 (a) As used in this amendment, the term "low-speed
40	40	7 vehicle" means a four-wheeled motor vehicle with a top speed
41	41	8 of not greater than 25 miles per hour, which has a
42	42	9 gross vehicle weight rating of less than 3,000 pounds, and is
43	43	10 certified as complying with the applicable federal safety
44	44	11 standards, including 49 C.F.R. § 571.500, as amended.
45	45	12 (b)(1) The governing body of a municipality in
46	46	13 Shelby County, by ordinance, may authorize and regulate the
47	47	14 operation of low-speed vehicles on certain public roads within
48	48	15 the corporate limits of the municipality, as determined by the
49	49	16 governing body of the municipality.
50	50	17 (2) The Shelby County Commission, by resolution, may
51	51	18 authorize and regulate the operation of low-speed vehicles on
52	52	19 certain public roads in the unincorporated portions of the
53	53	20 county, as determined by the county commission.
54	54	21 Section 2. An election upon the proposed amendment
55	55	22 shall be held in accordance with Section 284.01 of the
56	56	23 Constitution of Alabama of 1901, now appearing as Section
57	57	24 284.01 of the Official Recompilation of the Constitution of
58	58	25 Alabama of 1901, as amended, and the election laws of this
59	59	26 state.
60	60	Page 2 1 Section 3. The appropriate election official shall
61	61	2 assign a ballot number for the proposed constitutional
62	62	3 amendment on the election ballot and shall set forth the
63	63	4 following description of the substance or subject matter of
64	64	5 the proposed constitutional amendment:
65	65	6 "Relating to Shelby County, proposing an amendment
66	66	7 to the Constitution of Alabama of 1901, to authorize the
67	67	8 Shelby County Commission and municipalities within the county
68	68	9 to authorize and regulate the use of low-speed vehicles,
69	69	10 including certain golf carts, on certain public roads.
