8 SYNOPSIS:         Under existing law, with certain exceptions,
9	low-speed vehicles, including golf carts, may not
10	operate on the public roads of this state.
11	This bill would propose an amendment to the
12	Constitution of Alabama of 1901, to authorize the
13	Shelby County Commission and municipalities within
14	the county to authorize and regulate the use of
15	low-speed vehicles, including many golf carts, on
16	certain public roads.

18	A BILL
19	TO BE ENTITLED
20	AN ACT
21 
22	Relating to Shelby County; to propose an amendment
23 to the Constitution of Alabama of 1901, to authorize the
24 Shelby County Commission and municipalities within the county
25 to authorize the use of low-speed vehicles on certain public
26 roads.
27 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
Page 1 1	Section 1. The following amendment to the
2 Constitution of Alabama of 1901, is proposed and shall become
3 valid as a part of the Constitution when all requirements of
4 this act are fulfilled:
5	PROPOSED AMENDMENT
6	(a) As used in this amendment, the term "low-speed
7 vehicle" means a four-wheeled motor vehicle with a top speed
8 of not greater than 25 miles per hour, which has a
9 gross vehicle weight rating of less than 3,000 pounds, and is
10 certified as complying with the applicable federal safety
11 standards, including 49 C.F.R. ยง 571.500, as amended.
12	(b)(1) The governing body of a municipality in
13 Shelby County, by ordinance, may authorize and regulate the
14 operation of low-speed vehicles on certain public roads within
15 the corporate limits of the municipality, as determined by the
16 governing body of the municipality.
17	(2) The Shelby County Commission, by resolution, may
18 authorize and regulate the operation of low-speed vehicles on
19 certain public roads in the unincorporated portions of the
20 county, as determined by the county commission.
21	Section 2. An election upon the proposed amendment
22 shall be held in accordance with Section 284.01 of the
23 Constitution of Alabama of 1901, now appearing as Section
24 284.01 of the Official Recompilation of the Constitution of
25 Alabama of 1901, as amended, and the election laws of this
26 state.
Page 2 1	Section 3. The appropriate election official shall
2 assign a ballot number for the proposed constitutional
3 amendment on the election ballot and shall set forth the
4 following description of the substance or subject matter of
5 the proposed constitutional amendment:
6	"Relating to Shelby County, proposing an amendment
7 to the Constitution of Alabama of 1901, to authorize the
8 Shelby County Commission and municipalities within the county
9 to authorize and regulate the use of low-speed vehicles,
10 including certain golf carts, on certain public roads.
11	"Proposed by Act _________"
12	This description shall be followed by the following
13 language:
14	"Yes ( ) No ( )."
