13-6 ENROLLED, An Act,
14-7 Relating to any Class 6 municipality in which the
15-8 city government consists of a mayor and five members of the
16-9 city council elected for staggered terms; to further authorize
17-10 the revision of the election dates and terms of office of the
18-11 mayor and members of the city council.
19-12 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
20-13 Section 1. This act shall apply to any Class 6
21-14 municipality in which the city government on the effective
22-15 date of this act consists of a mayor and five members of the
23-16 city council elected for staggered terms.
24-17 Section 2. In any Class 6 municipality to which this
25-18 act applies, the city council of the municipality may adopt an
26-19 ordinance revising the election dates and terms of the city
27-20 council and mayor as provided in this section. The ordinance,
28-21 if enacted, shall provide:
29-22 (1) That the members of the city council to be
30-23 elected at the general municipal election in 2022 shall be
31-24 elected for terms of five years commencing on the first Monday
32-25 in November 2022, and successors shall be elected for terms of

34-1 four years at a general municipal election in 2027, for terms
35-2 commencing on the first Monday in November 2027, and every
36-3 four years thereafter.
37-4 (2) The terms of the mayor and the members of the
38-5 city council set to expire in 2024 shall be extended by one
39-6 year to expire in 2025, and successors to the offices of mayor
40-7 and city council shall be elected for terms of four years at a
41-8 general municipal election in 2025, for terms commencing on
42-9 the first Monday in November 2025, and every four years
43-10 thereafter.
44-11 Section 3. The provisions of this act are
45-12 supplemental and shall not be construed to repeal any law not
46-13 in direct conflict with this act.
47-14 Section 4. This act shall become effective
48-15 immediately following its passage and approval by the
49-16 Governor, or its otherwise becoming law.

14+8 SYNOPSIS: Under existing law, the city council of a
15+9 Class 6 municipality, by ordinance, may provide for
16+10 the terms of members of the city council to be
17+11 staggered. The elections are held in even-numbered
18+12 years.
19+13 This bill would provide that the city
20+14 council of a Class 6 municipality in which the
21+15 terms of members of the city council are staggered,
22+16 by ordinance, may revise the terms and the election
23+17 dates of the city council and mayor so that the
24+18 general municipal elections would be held in
25+19 odd-numbered years and the terms of the city
26+20 council would continue to be staggered.
