36-therewith would have as its purpose or effect the requirement
37-of a new or increased expenditure of local funds within the
38-meaning of Section 111.05 of the Constitution of Alabama of
39-2022.
40-BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
41-Section 1. Division 9, commencing with Section
42-41-29-350, is added to Article 3, Chapter 29, Title 41 of the
43-Code of Alabama 1975, to read as follows:

19+SYNOPSIS:
20+This bill would establish the Alabama Credential
21+Quality and Transparency Act and the Alabama Workforce
22+Council Committee on Credential Quality and
23+Transparency; would establish the Alabama Terminal on
24+Linking and Analyzing Statistics (ATLAS) on Career
25+Pathways Act; and would establish the Alabama College
26+and Career Readiness Act.
27+Section 111.05 of the Constitution of Alabama of
28+2022, prohibits a general law whose purpose or effect
29+would be to require a new or increased expenditure of
30+local funds from becoming effective with regard to a
31+local governmental entity without enactment by a 2/3
32+vote unless: it comes within one of a number of
33+specified exceptions; it is approved by the affected
34+entity; or the Legislature appropriates funds, or
35+provides a local source of revenue, to the entity for
36+the purpose.
37+The purpose or effect of this bill would be to
38+require a new or increased expenditure of local funds
39+within the meaning of the amendment. However, the bill
40+does not require approval of a local governmental
41+entity or enactment by a 2/3 vote to become effective
42+because it comes within one of the specified exceptions
43+contained in the amendment.

74-This division shall be known and may be cited as the
75-Alabama Credential Quality and Transparency Act.
76-§41-29-351
77-For the purposes of this division, the following terms
78-shall have the following meanings:
79-(1) COMMITTEE. The Alabama Workforce Council Committee
80-on Credential Quality and Transparency.
81-(2) COMPETENCY. Measurable or observable knowledge,
82-skills, and abilities.
83-(3) CREDENTIAL. A qualification, achievement, or
84-recognition of competence.
85-(4) REGISTRY. The Alabama Credential Registry, which
86-is a virtual repository of state competency and credential
87-data.
88-(5) TRANSPARENCY. The availability of deidentified
89-data about credentials as linked, open, and interoperable
90-data aligned with widely recognized standards.

92-(a) The committee shall advise the Alabama Committee
93-on Credentialing and Career Pathways on making credential and
94-competency data, collected through the registry created by
95-this division, publicly available.
96-(b) The appointing authorities shall coordinate their
97-appointments to assure the committee membership is inclusive
98-and reflects the racial, gender, geographic, urban, rural,
99-and economic diversity of the state. The committee shall be
100-composed of the following members:

156-to the public and shall be deidentified. Credential data
157-shall be linked, open, interoperable, aligned with widely
158-recognized standards, and all allow for open access across

304-various agencies and programs over time to create reports
305-that may then be aggregated and analyzed to assist policy
306-makers with developing strategies to improve education and
307-workforce outcomes. The system shall be configured in the
308-following manner:
309-(1) All information matched from partner entities
310-shall be collected, safeguarded, kept confidential, and used
311-only by the office in accordance with this division and other
312-state and federal law.
313-(2) Each partner entity shall retain ownership of any
314-data the partner entity provides to the system and shall
315-reserve the right to opt out of any research request if the
316-request would violate state or federal law. To that end, all
317-of the following shall apply:
318-a. A partner entity may not have access to data owned
319-by another partner entity unless a data request is approved
320-unanimously by the council.
321-b. Nothing in this division or council rule or policy
322-may prevent partner entities from engaging in direct data
323-sharing agreements with other partner entities or with
324-external entities, so long as the data to be shared is owned
325-by the contracting parties.
326-(3) The system shall conduct research related to the
327-research agenda adopted by the council.

363-council shall consist of all of the following:

369-(3) The Chair of the House Ways and Means Education

371-(4) The Chair of the Senate Finance and Taxation

373-(5) The Chair of the Alabama Workforce Council.
374-(6) Up to four members of the public, who are
375-experienced in education and workforce data and statistics,
376-who shall be appointed by the Governor and serve at the
377-pleasure of the Governor.
378-(c) The council shall perform all of the following
379-duties:
380-(1) Develop a strategic plan.
381-(2) Oversee the development, adoption, and
382-implementation of rules to govern the proceedings of the
383-council, the office, and the system.
384-(3) Oversee compliance regarding the protection of
385-data shared with the system.
386-(4) Develop a data governance and security plan for

355+education, workforce training, and employment outcomes. The
356+system makes it possible to match data from various agencies

430-Representatives; President Pro Tempore of the Senate; Chairs
431-of the House Education Policy, Senate Education Policy, House
432-Ways and Means Education, and Senate Finance and Taxation
433-Education Committees; and the State Board of Education.

435-(a) Except as otherwise provided in subsection (a) of
436-Section 41-29-365, the regular meetings of the council shall
437-be held at the call of the chair, at least four times per
438-state fiscal year; special meetings of the council may be
439-called by the chair, or upon written request of a majority of
440-the members of the council; and all regular and special
441-meetings of the council shall comply with the Open Meetings
442-Act.
443-(b) A majority of the members of the council, or their

487+(a) Except as otherwise provided in subsection (a) of
488+Section 41-29-365, the regular meetings of the council shall
489+be held at the call of the chair, at least four times per
490+state fiscal year; special meetings of the council may be

492+the members of the council; and all regular and special
493+meetings of the council shall comply with the Open Meetings
494+Act.
495+(b) A majority of the members of the council, or their
473496 designees, shall constitute a quorum for the transaction of
474-business.
475-(c) Each member of the council may appoint, in writing
476-to the chair, a designee to represent him or her during the
477-proceedings of the council.
478-(d) The members of the council shall not receive a
479-salary or per diem allowance for their service but shall be
480-reimbursed through the Department of Commerce for expenses
481-incurred in the performance of their duties for the office at
482-the same rate as provided for state employees.
483-(e) Direct access to data in the system is restricted
