Enrolled, An Act,
Relating to Shelby County; to amend Section 3 of Act
79-524, 1979 Regular Session, (Acts 1979, p. 935), as last
amended by Act 2015-343 of the 2015 Regular Session (Acts
2015, p. 1069), establishing a personnel board for employees
of county law enforcement officers in the county; to provide
for the compensation of the chief deputy sheriff, the
operations manager, and up to two majors in the sheriff's
department; and to repeal Act 2009-336 of the 2009 Regular
Session (Acts 2009, p. 576), relating to the compensation of
the chief deputy sheriff.
BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
Section 1. Section 3 of Act 79-524 of the 1979 Regular
Session, (Acts 1979, p. 935), as last amended by Act 2015-343
of the 2015 Regular Session (Acts 2015, p. 1069), is amended
to read as follows:
"Section 3. This act shall apply to all law enforcement
employees of Shelby County but shall not apply to the
following persons except as provided herein : (a) elective
officers of the county or any municipality therein; (b)
members of county or municipal appointive boards, commissions,
and committees; (c) all employees of county or municipal
boards of education engaged in the profession of teaching or
in supervising teaching in the public schools; (d) the judge
of any court; (e) any employee of the United States government
or any agency thereof; (f) any employee of the State of

Alabama or any departments therein; and (g) the chief deputy
sheriff in the sheriff's department ;(h),the operations manager
of the Shelby County Sheriff's Department who shall be
appointed by the sheriff in the unclassified service of the
county and serve at the pleasure of the sheriff; in the
sheriff's department, and (i) up to two majors in the
sheriff's department, who each of whom shall be appointed by
and serve at the pleasure of the sheriff in the unclassified
service of the county and shall not be subject to the board
and whose compensation shall be 10 percent greater than the
highest paid classified service county law enforcement
employee of Shelby County. except the compensation of the
chief deputy sheriff, the operations manager, and any majors
appointed by the sheriff shall be set in accordance with the
pay and compensation plan established by the county commission
at the grade and step approved by the sheriff. "
Section 2. Act 2009-336 of the 2009 Regular Session
(Acts 2009, p. 576), relating to the compensation of the Chief
Deputy Sheriff of Shelby County, is repealed.
Section 3. This act shall become effective immediately
following its passage and approval by the Governor, or its
otherwise becoming law.
