1717 SYNOPSIS:
1818 Under existing law, a person is guilty of
1919 permitting livestock or animals to run at large in the
2020 State of Alabama upon the premises of another or public
2121 lands if they do so knowingly, voluntarily,
2222 negligently, or willfully.
2323 This bill would provide that no municipal
2424 governing body may adopt or continue in effect any
2525 ordinance, rule, resolution, or directive that
2626 prohibits this same conduct but does not require the
2727 same mental state as state law.
2828 This bill would also make nonsubstantive,
2929 technical revisions to update the existing code
3030 language to current style.

3434 Relating to livestock; to amend Section 3-5-2, Code of
3535 Alabama 1975, to provide that no municipal governing body may
3636 adopt or continue in effect any ordinance, rule, resolution,

7272 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
7373 Section 1. Section 3-5-2, Code of Alabama 1975, is
7474 amended to read as follows:
7575 "ยง3-5-2
7676 (a) It shall be unlawful for the owner of any livestock
7777 or animal, as defined in Section 3-5-1, to knowingly,
7878 voluntarily, negligently , or wilfully permit any such
7979 livestock or animal to go run at large in the State of Alabama
8080 either upon the premises of another or upon the public lands,
8181 highways, roads, or streets in the State of Alabama.
8282 (b) Nothing in this section or elsewhere in this
8383 chapter shall be construed to make it unlawful for livestock
8484 or other animals to run at large on the premises of another
8585 when the owner or person in charge of the premises has
8686 consented in writing to let allow livestock or other animals
8787 to run at large on the same or to subject the owner of such
8888 livestock or other animals to criminal prosecution therefor
8989 premises.
9090 (c) There shall be no "open range" counties in this
9191 state. This section shall apply to all counties within the
9292 state.
9393 (d) Any person or persons owning or having the
9494 possession, custody , or control of any livestock who
9595 unlawfully and knowingly permit the same to run or be at

125125 large, shall be guilty of a misdemeanor, and, on conviction,
126126 shall be fined not less than double the damages sustained by
127127 the injured party or parties, but in no case more than $50.00
128128 fifty dollars ($50) , one half of such fine to go to the
129129 injured party or parties, and may also be imprisoned in the
130130 county jail or sentenced to hard labor for the county for a
131131 term not exceeding six months at the discretion of the court
132132 trying the case.
133133 (e) No municipal governing body may adopt or continue
134134 in effect any ordinance, rule, resolution, or other directive
135135 that is inconsistent with this section. For purposes of this
136136 subsection, an ordinance, rule, resolution, or directive shall
137137 be considered inconsistent with this section if it proscribes
138138 the same conduct prohibited by this section and provides no
139139 requisite mental state or a mental state different than what
140140 is provided in subsection (a) or (d). "
141141 Section 2. This act shall become effective on the first
142142 day of the third month following its passage and approval by
143143 the Governor, or its otherwise becoming law.
