1313 SYNOPSIS:
1414 This bill would establish a list of criminal
1515 offenses which are deemed to be felonies dangerous to
1616 human life.
1717 This bill would provide enhanced criminal
1818 penalties for the possession, brandishing, or discharge
1919 of a firearm during the commission of a felony
2020 dangerous to human life.
2121 This bill would provide prohibitions on the
2222 possession of a firearm by certain individuals released
2323 on bond or personal recognizance when the underlying
2424 criminal offense for which the person was arrested is a
2525 felony dangerous to human life.
2626 This bill would prohibit the possession of a
2727 firearm by certain individuals previously convicted of
2828 a felony dangerous to human life within a 25-year
2929 period.
3030 This bill would also provide criminal penalties
3131 for a violation.
3232 Section 111.05 of the Constitution of Alabama of
3333 2022, prohibits a general law whose purpose or effect
3434 would be to require a new or increased expenditure of
3535 local funds from becoming effective with regard to a
3636 local governmental entity without enactment by a 2/3
3737 vote unless: it comes within one of a number of

6868 entity; or the Legislature appropriates funds, or
6969 provides a local source of revenue, to the entity for
7070 the purpose.
7171 The purpose or effect of this bill would be to
7272 require a new or increased expenditure of local funds
7373 within the meaning of the amendment. However, the bill
7474 does not require approval of a local governmental
7575 entity or enactment by a 2/3 vote to become effective
7676 because it comes within one of the specified exceptions
7777 contained in the amendment.

8181 Relating to firearms; to amend Section 13A-11-84, Code
8282 of Alabama 1975; to establish a list of criminal offenses

122122 its purpose or effect the requirement of a new or increased
123123 expenditure of local funds within the meaning of Section
124124 111.05 of the Constitution of Alabama of 2022.
125125 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
126126 Section 1. As used in this act, the term "felony
127127 dangerous to human life" shall include any of the following
128128 offenses
129129 (1) Capital murder pursuant to Sections 13A-6-2 and
130130 13A-5-40, Code of Alabama 1975.
131131 (2) Murder pursuant to Section 13A-6-2, Code of Alabama
132132 1975.
133133 (3) Manslaughter pursuant to Section 13A-6-3, Code of
134134 Alabama 1975, except the term does not include manslaughter
135135 arising out of the operation of a vehicle.
136136 (4) A sex offense that is enumerated under Section
137137 15-20A-5, Code of Alabama 1975, which involves any of the
138138 following:
139139 a. Force.
140140 b. Incapacitation.
141141 c. A child under 12 years of age.
142142 (5) Assault I pursuant to Section 13A-6-20, Code of
143143 Alabama 1975.
144144 (6) Assault II pursuant to Section 13A-6-21, Code of
145145 Alabama 1975.
146146 (7) Kidnapping I pursuant to Section 13A-6-43, Code of
147147 Alabama 1975.
148148 (8) Kidnapping II pursuant to Section 13A-6-44, Code of

247247 (28) Any substantially similar offense for which an
248248 Alabama offender has been convicted under prior Alabama law or
249249 the law of any other state, the District of Columbia, the
250250 United States, or any of the territories of the United States.
251251 Section 2. (a)(1) Any person who knowingly possesses or
252252 brandishes, as provided in Section 13A-11-7(c), a firearm
253253 during the commission or attempted commission of a felony
254254 dangerous to human life, in addition to any other term of
255255 imprisonment, shall be sentenced to a term of imprisonment of
256256 not less than 10 years.
257257 (2) Any person who knowingly discharges a firearm
258258 during the commission or attempted commission of a felony
259259 dangerous to human life, in addition to any other term of
260260 imprisonment, shall be sentenced to a term of imprisonment of
261261 not less than 15 years.
262262 (b) A person who commits a second or subsequent

292292 violation of subdivision (1) or (2) of subsection (a) shall be
293293 sentenced to an additional term of imprisonment of not less
294294 than 20 years.
295295 (c) Notwithstanding any other provision of law, any
296296 term of imprisonment imposed pursuant to this section shall
297297 run consecutive with any other term of imprisonment for any
298298 other offense and shall not be eligible for any of the
299299 following:
300300 (1) Probation.
301301 (2) Community corrections.
302302 (3) Any split or suspended sentence provision pursuant
303303 to Section 15-18-8, Code of Alabama 1975.
304304 (4) Any type of early release program, work release
305305 program, good time, or any other program which would change
306306 the overall time or location of incarceration.
307307 (5) Any sentencing schedule or worksheet adopted,
308308 created, or otherwise released by the Alabama Sentencing
309309 Commission.
310310 Section 3. (a) It shall be unlawful for any person
311311 charged with the commission or attempted commission of any
312312 felony dangerous to human life, and thereafter released on
313313 bond or personal recognizance, to knowingly have a firearm in
314314 his or her possession or under his or her control.
315315 (b) Unless waived by the defendant, a person may not be
316316 convicted for violating this section unless the person is
317317 first convicted of having committed a felony dangerous to
318318 human life, or a lesser included offense, which gave rise to
319319 the charge and for which the person was released on bail or

350350 (c)(1) Any person who violates subsection (a) shall be
351351 guilty of a Class B felony and imprisoned for not less than 5
352352 years.
353353 (2) Upon a second or subsequent violation of subsection
354354 (a), the person shall be guilty of a Class A felony and
355355 sentenced to a term of imprisonment of not less than 10 years.
356356 (d) The penalties provided in subsection (c) shall be
357357 in addition to any penalty provided for the underlying felony
358358 dangerous to human life which gave rise to the charge under
359359 this section.
360360 (e) Notwithstanding any other provision of law, the
361361 term of imprisonment provided in subsection (c) shall run
362362 consecutive with any other term of imprisonment for any other
363363 offense and the person shall not be eligible for any of the
364364 following:

375375 Section 4. (a) It shall be unlawful for any person to

408408 commit a felony dangerous to human life.
409409 (b)(1) Any person who knowingly violates subsection (a)
410410 shall be guilty of a Class B felony and imprisoned for not
411411 less than 5 years.
412412 (2) Upon a second or subsequent violation of subsection
413413 (a), the person shall be guilty of a Class A felony and
414414 sentenced to a term of imprisonment of not less than 10 years.

463463 the act amending this section, a violation of subsection (a)
464464 of Section 13A-11-72 (a) or Section 13A-11-81 shall be a Class
465465 C felony.
466466 (b) Every violation of subsection (b) of Section
467467 13A-11-72 or Sections 13A-11-73, 13A-11-74, 13A-11-76, and
468468 13A-11-77 through 13A-11-80 shall be a Class A misdemeanor.
469469 The punishment for violating Section 13A-11-78 or 13A-11-79
470470 may include revocation of license.
471471 (b)(c)(1) It shall be the duty of any sheriff,
472472 policeman, or other peace officer of the State of Alabama, law
473473 enforcement officer in this state arresting any person charged
474474 with violating Sections 13A-11-71 through 13A-11-73, or any
475475 one or more of those sections, to seize the pistol or pistols
476476 in the possession or under the control of the person or
477477 persons charged with violating the section or sections, and to
478478 deliver the pistol or pistols to one of the following named
479479 persons:
480480 a.ifIf a municipal officer makes the arrest, to the
481481 city clerk or custodian of stolen property of the municipality
482482 employing the arresting officer ; if.
483483 b. If a county, state, or other peace officer makes the
484484 arrest, to the sheriff of the county in which the arrest is
485485 made.
486486 (2) The person receiving the pistol or pistols from the
487487 arresting officer shall keep it in a safe place in as good
488488 condition as received until disposed of as hereinafter
489489 provided in this subsection .
490490 (3) Within five days after the final conviction of any

520520 person arrested for violating any of the above-numbered
521521 sections enumerated in subsection (a) , the person receiving
522522 possession of the pistol or pistols, seized as provided in
523523 this section, shall report the seizure and detention of the
524524 pistol or pistols to the district attorney within the county
525525 where the pistol or pistols are seized , giving a full
526526 description thereof, including the number, make , and model
527527 thereof, the name of the person in whose possession it was
528528 found when seized, the person making claim to same or any
529529 interest therein, if the name can be ascertained or is known,
530530 and the date of the seizure.
531531 (4) Upon receipt of the report from the person
532532 receiving possession of the pistol or pistols, it shall be the
533533 duty of the district attorney within the county wherein the
534534 pistol or pistols were seized to forthwith the district
535535 attorney shall file a complaint in the circuit court of the
536536 proper county, praying requesting that the seized pistol or
537537 pistols be declared contraband, be forfeited to the state , and
538538 be destroyed or used for law enforcement purposes .
539539 (5) Any person, firm or corporation , or association of
540540 persons in whose possession claiming to own or have an
541541 interest in the pistol or pistols may be seized or who claim
542542 to own the same or any interest therein shall be made a party
543543 defendant to the complaint, and thereupon the matter shall
544544 proceed and be determined in the circuit court of the proper
545545 county in the same form and manner , as near as may be, as in
546546 the forfeiture and destruction of gaming devices, except as
547547 otherwise provided.

577577 (6) When any judgment of condemnation and forfeiture is
578578 made in any case filed under this section, the judge making
579579 the judgment court shall direct the destruction of the pistol
580580 or pistols by the person receiving possession of the pistol or
581581 pistols from the arresting officer in the presence of the
582582 clerk or register of the court , unless the judge .
583583 (7) Notwithstanding subdivision (6), if the court is of
584584 the opinion that the nondestruction thereof of the pistol or
585585 pistols is necessary or proper in the ends of justice, in
586586 which event and upon recommendation of the district attorney,
587587 the judge court shall award the pistol or pistols to the
588588 sheriff of the county or to the chief of police of the
589589 municipality to be used exclusively by the sheriff or the
590590 chief of police in the enforcement of law, and the for law
591591 enforcement purposes. The sheriff of the county and the chiefs
592592 of police of the municipalities shall keep a permanent record
593593 of all pistols awarded to them , as provided for in this
594594 section, to be accounted for as other public property , and the
595595 order, in.
596596 (8) In the event that no appeal is taken within 15 days
597597 from the rendition thereof , the court's order shall be carried
598598 out and executed before the expiration of 20 days from the
599599 date of the judgment. The court may direct in the judgment
600600 that the costs of the proceedings be paid by the person in
601601 whose possession the pistol or pistols were found when seized,
602602 or by any party or parties who claim to own the pistol or
603603 pistols, or any interest therein, and who contested the
604604 condemnation and forfeiture thereof."

634634 Section 6. Although this bill would have as its purpose
635635 or effect the requirement of a new or increased expenditure of
636636 local funds, the bill is excluded from further requirements
637637 and application under Section 111.05 of the Constitution of
638638 Alabama of 2022, because the bill defines a new crime or
639639 amends the definition of an existing crime.
640640 Section 7. This act shall become effective on the first
641641 day of the third month following its passage and approval by
642642 the Governor, or its otherwise becoming law.
