	15	+	AN ACT
16	16		Relating to Randolph County; to amend Sections 2 and 5
17	17		of Act 2021-307 of the 2021 Regular Session, relating to the
18	18		coroner; to provide for the salary of the coroner effective at
19	19		the beginning of the current term in order to implement Act
20	20		2021-301 as intended; and to provide that this act is
21	21		retroactive and curative to January 16, 2023.
22	22		BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
23	23		Section 1. Section 2 and Section 5 of Act 2021-307 of
24	24		the 2021 Regular Session, are amended to read as follows:
25	25		"Section 2.(a) Effective beginning the next term of
26	26		office of the coroner, 60 days prior to the first day for
27	27		qualifying in the election for the office of Coroner of
28	28		Randolph County for the next term of office, the Randolph
29	29		County Commission may increase and set January 16, 2023, the
30	30		annual salary of the coroner for the next term of office at an
31	31		amount not to exceed shall be one thousand dollars ($1,000)
32	32		per month to be paid from the county general fund.
33	33		(b) Effective beginning the next term of office of the
34	34		coroner commencing in January 2027, and each term thereafter,
35	35		not less than 60 days prior to the first day for qualifying in
36		-	the election for the term, the Randolph County Commission may
37		-	increase and set the annual salary of the coroner commencing
38		-	on the beginning of that term of office, and thereafter, as
39		-	determined by the county commission.
40		-	(c) The salaries provided in this section shall be in
41		-	lieu of any other salary, compensation, fees, or allowances

	65	+	the election for the term, the Randolph County Commission may
	66	+	increase and set the annual salary of the coroner commencing
	67	+	on the beginning of that term of office, and thereafter, as
	68	+	determined by the county commission.
	69	+	(c) The salaries provided in this section shall be in
	70	+	lieu of any other salary, compensation, fees, or allowances
71	71		provided to the coroner. The coroner shall waive any other
72	72		fees or compensation in order to receive any salary provided
73	73		by this act.
74	74		(d)(1) The Randolph County Commission may authorize the
75	75		coroner to participate in retirement and the county health
76	76		insurance under the terms and conditions as the county
77	77		commission may determine and may expend county funds for that
78	78		purpose. Any benefits provided under this section shall be
79	79		approved by the county commission not less than 60 days prior
80	80		to the first day for qualifying for election to the office
81	81		coroner.
82	82		(2) The Legislature finds that the Coroner of Randolph
83	83		County is a full-time official and is on-call 24 hours a day,
84	84		seven days a week to perform the duties of the office."
85	85		"Section 5. Effective beginning the next term of office
86	86		of the coroner, Act 2004-273 of the 2004 Regular Session (Acts
87	87		2004, p. 379), is repealed effective upon the implementation
88	88		of this amendatory act ."
89	89		Section 2. This act is retroactive and curative to
90	90		January 16, 2023, in order to implement Act 2021-307 as
91	91		amended. Any salary or other compensation paid to the coroner
92	92		in conformance with this act is ratified confirmed effective
93		-	retroactively to January 16, 2023.
94		-	Section 3. This act shall become effective immediately
95		-	following its passage and approval by the Governor, or its
96		-	otherwise becoming law.
