Enrolled, An Act,
Relating to Randolph County; to amend Sections 2 and 5
of Act 2021-307 of the 2021 Regular Session, relating to the
coroner; to provide for the salary of the coroner effective at
the beginning of the current term in order to implement Act
2021-301 as intended; and to provide that this act is
retroactive and curative to January 16, 2023.
BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
Section 1. Section 2 and Section 5 of Act 2021-307 of
the 2021 Regular Session, are amended to read as follows:
"Section 2.(a) Effective beginning the next term of
office of the coroner, 60 days prior to the first day for
qualifying in the election for the office of Coroner of
Randolph County for the next term of office, the Randolph
County Commission may increase and set January 16, 2023, the
annual salary of the coroner for the next term of office at an
amount not to exceed shall be one thousand dollars ($1,000)
per month to be paid from the county general fund.
(b) Effective beginning the next term of office of the
coroner commencing in January 2027, and each term thereafter,
not less than 60 days prior to the first day for qualifying in
the election for the term, the Randolph County Commission may
increase and set the annual salary of the coroner commencing
on the beginning of that term of office, and thereafter, as
determined by the county commission.
(c) The salaries provided in this section shall be in
lieu of any other salary, compensation, fees, or allowances

provided to the coroner. The coroner shall waive any other
fees or compensation in order to receive any salary provided
by this act.
(d)(1) The Randolph County Commission may authorize the
coroner to participate in retirement and the county health
insurance under the terms and conditions as the county
commission may determine and may expend county funds for that
purpose. Any benefits provided under this section shall be
approved by the county commission not less than 60 days prior
to the first day for qualifying for election to the office
coroner. 
(2) The Legislature finds that the Coroner of Randolph
County is a full-time official and is on-call 24 hours a day,
seven days a week to perform the duties of the office." 
"Section 5. Effective beginning the next term of office
of the coroner, Act 2004-273 of the 2004 Regular Session (Acts
2004, p. 379), is repealed effective upon the implementation
of this amendatory act ."
Section 2. This act is retroactive and curative to
January 16, 2023, in order to implement Act 2021-307 as
amended. Any salary or other compensation paid to the coroner
in conformance with this act is ratified confirmed effective
retroactively to January 16, 2023. 
Section 3. This act shall become effective immediately
following its passage and approval by the Governor, or its
otherwise becoming law.
