1717 SYNOPSIS:
1818 Under existing law, when a public works contract
1919 requires the use of steel, the contractor performing
2020 the contract is required to use steel produced within
2121 the United States.
2222 This bill would provide that when a public works
2323 contract requires the use of timber, the contractor
2424 performing the contract would be required to use timber
2525 produced within the United States.

2929 Relating to public contracts; to amend Section 39-3-4,
3030 Code of Alabama 1975, to provide requirements for the use of
3131 timber produced within the United States for certain public
3232 works projects under certain conditions.
3333 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3434 Section 1. Section 39-3-4, Code of Alabama 1975, is
3535 amended to read as follows:

3737 (a) Any contractor for a public works project, financed
3838 entirely by the State of Alabama or any political subdivision

6868 thereof, within this state shall use timber or steel produced
6969 within the United States when specifications in the
7070 construction contract require the use of timber or steel and
7171 do not limit its supply to a sole source under subsection (f)
7272 of Section 39-2-2. If the awarding authority decides that the
7373 procurement of the above mentioned domestic timber or steel
7474 products becomes impractical as a result of a national
7575 emergency, national strike, or other cause, the awarding
7676 authority shall waive the above restriction.
7777 (b) In the event the contractor violates the domestic
7878 timber or steel requirements of subsection (a), and domestic
7979 timber or steel is not used, there shall be a downward
8080 adjustment in the contract price equal to any realized savings
8181 or benefits to the contractor."
8282 Section 2. This act shall become effective on the first
8383 day of the third month following its passage and approval by
8484 the Governor, or its otherwise becoming law.
