17	17	SYNOPSIS:
18	18	Under existing law, when a public works contract
19	19	requires the use of steel, the contractor performing
20	20	the contract is required to use steel produced within
21	21	the United States.
22	22	This bill would provide that when a public works
23	23	contract requires the use of timber, the contractor
24	24	performing the contract would be required to use timber
25	25	produced within the United States.

27	27	TO BE ENTITLED
28	28	AN ACT
29	29	Relating to public contracts; to amend Section 39-3-4,
30	30	Code of Alabama 1975, to provide requirements for the use of
31	31	timber produced within the United States for certain public
32	32	works projects under certain conditions.
33	33	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
34	34	Section 1. Section 39-3-4, Code of Alabama 1975, is
35	35	amended to read as follows:
36	36	"§39-3-4
37	37	(a) Any contractor for a public works project, financed
38	38	entirely by the State of Alabama or any political subdivision

68	68	thereof, within this state shall use timber or steel produced
69	69	within the United States when specifications in the
70	70	construction contract require the use of timber or steel and
71	71	do not limit its supply to a sole source under subsection (f)
72	72	of Section 39-2-2. If the awarding authority decides that the
73	73	procurement of the above mentioned domestic timber or steel
74	74	products becomes impractical as a result of a national
75	75	emergency, national strike, or other cause, the awarding
76	76	authority shall waive the above restriction.
77	77	(b) In the event the contractor violates the domestic
78	78	timber or steel requirements of subsection (a), and domestic
79	79	timber or steel is not used, there shall be a downward
80	80	adjustment in the contract price equal to any realized savings
81	81	or benefits to the contractor."
82	82	Section 2. This act shall become effective on the first
83	83	day of the third month following its passage and approval by
84	84	the Governor, or its otherwise becoming law.
