SYNOPSIS:
Under existing law, when a public works contract
requires the use of steel, the contractor performing
the contract is required to use steel produced within
the United States.
This bill would provide that when a public works
contract requires the use of timber, the contractor
performing the contract would be required to use timber
produced within the United States.
A BILL
TO BE ENTITLED
AN ACT
Relating to public contracts; to amend Section 39-3-4,
Code of Alabama 1975, to provide requirements for the use of
timber produced within the United States for certain public
works projects under certain conditions.
BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
Section 1. Section 39-3-4, Code of Alabama 1975, is
amended to read as follows:
"ยง39-3-4
(a) Any contractor for a public works project, financed
entirely by the State of Alabama or any political subdivision

thereof, within this state shall use timber or steel produced
within the United States when specifications in the
construction contract require the use of timber or steel and
do not limit its supply to a sole source under subsection (f)
of Section 39-2-2. If the awarding authority decides that the
procurement of the above mentioned domestic timber or steel
products becomes impractical as a result of a national
emergency, national strike, or other cause, the awarding
authority shall waive the above restriction.
(b) In the event the contractor violates the domestic
timber or steel requirements of subsection (a), and domestic
timber or steel is not used, there shall be a downward
adjustment in the contract price equal to any realized savings
or benefits to the contractor."
Section 2. This act shall become effective on the first
day of the third month following its passage and approval by
the Governor, or its otherwise becoming law.
