	17	+	AN ACT
15	18		Relating to Talladega County; to amend Sections 1 and 3
16	19		of Act 91-522 of the 1991 Regular Session (Acts 1991, p. 923),
17	20		as amended by Act 2018-101 of the 2018 Regular Session, to
18	21		further provide for the employment and duties of the county
19	22		engineer; and to repeal Section 2 of Act 91-522, providing for
20	23		nominations to fill the position by the state highway
21	24		director.
22	25		BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
23	26		Section 1. Sections 1 and 3 of Act 91-522 of the 1991
24	27		Regular Session (Acts 1991, p. 923), as amended, are amended
25	28		to read as follows:
26	29		"Section 1. The Talladega County Commission shall
27	30		employ, supervise, and direct a county engineer who shall be a
28	31		thoroughly qualified and competent civil engineer possessing
29	32		all of the qualifications as specified for county engineers
30	33		under the general laws of the State of Alabama, who shall
31	34		devote his or her entire time and attention to the maintenance
32	35		and construction of the Talladega County public roads,
33	36		highways, and bridges, and ferries; and who shall reside in
34	37		Talladega County during his or her employment. Notwithstanding
35		-	the foregoing, the Talladega County Commission may waive the
36		-	requirement that the county engineer reside in the county by a
37		-	majority vote of the county commission.
38		-	"Section 3. Subject to the approval and direction of
39		-	the county commission, It shall be the duty of the county

	67	+	the foregoing, the Talladega County Commission may waive the
	68	+	requirement that the county engineer reside in the county by a
	69	+	majority vote of the county commission.
	70	+	"Section 3. Subject to the approval and direction of
	71	+	the county commission, It shall be the duty of the county
	72	+	engineer, shall perform thosethe duties prescribed provided
70	73		for in Section 11-6-3, Code of Alabama 1975, and a) to employ,
71	74		supervise and direct all such assistants as are necessary to
72	75		maintain and construct the public roads, highways, bridges and
73	76		ferries of the county, to have authority to prescribe their
74	77		duties, and to discharge said employees for cause or when no
75	78		needed; b) to perform such engineering and surveying service
76	79		as may be required and to prepare and maintain the necessary
77	80		maps and records; c) to maintain the necessary accounting
78	81		records to reflect the cost of the county highway system; d)
79	82		to build, construct new roads or change old roads, but only
80	83		when order to do so by proper order to do so by proper order
81	84		of the county commission; and e) to shall construct and
82	85		maintain all paved and unpaved county roads on the basis of
83	86		the county as a unit without regard to any district or beat
84	87		lines."
85	88		Section 2. Section 2 of Act 91-522, providing for
86	89		nominations to fill the position of county engineer by the
87	90		state highway director, is repealed.
88	91		Section 3. This act shall become effective immediately
89	92		following its passage and approval by the Governor, or its
90	93		otherwise becoming law.
