1518 Relating to Talladega County; to amend Sections 1 and 3
1619 of Act 91-522 of the 1991 Regular Session (Acts 1991, p. 923),
1720 as amended by Act 2018-101 of the 2018 Regular Session, to
1821 further provide for the employment and duties of the county
1922 engineer; and to repeal Section 2 of Act 91-522, providing for
2023 nominations to fill the position by the state highway
2124 director.
2225 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2326 Section 1. Sections 1 and 3 of Act 91-522 of the 1991
2427 Regular Session (Acts 1991, p. 923), as amended, are amended
2528 to read as follows:
2629 "Section 1. The Talladega County Commission shall
2730 employ, supervise, and direct a county engineer who shall be a
2831 thoroughly qualified and competent civil engineer possessing
2932 all of the qualifications as specified for county engineers
3033 under the general laws of the State of Alabama, who shall
3134 devote his or her entire time and attention to the maintenance
3235 and construction of the Talladega County public roads,
3336 highways, and bridges, and ferries; and who shall reside in
3437 Talladega County during his or her employment. Notwithstanding
35-the foregoing, the Talladega County Commission may waive the
36-requirement that the county engineer reside in the county by a
37-majority vote of the county commission.
38-"Section 3. Subject to the approval and direction of
39-the county commission, It shall be the duty of the county
40-engineer, shall perform thosethe duties prescribed provided

67+the foregoing, the Talladega County Commission may waive the
68+requirement that the county engineer reside in the county by a

70+"Section 3. Subject to the approval and direction of

7073 for in Section 11-6-3, Code of Alabama 1975, and a) to employ,
7174 supervise and direct all such assistants as are necessary to
7275 maintain and construct the public roads, highways, bridges and
7376 ferries of the county, to have authority to prescribe their
7477 duties, and to discharge said employees for cause or when no
7578 needed; b) to perform such engineering and surveying service
7679 as may be required and to prepare and maintain the necessary
7780 maps and records; c) to maintain the necessary accounting
7881 records to reflect the cost of the county highway system; d)
7982 to build, construct new roads or change old roads, but only
8083 when order to do so by proper order to do so by proper order
8184 of the county commission; and e) to shall construct and
8285 maintain all paved and unpaved county roads on the basis of
8386 the county as a unit without regard to any district or beat
8487 lines."
8588 Section 2. Section 2 of Act 91-522, providing for
8689 nominations to fill the position of county engineer by the
8790 state highway director, is repealed.
8891 Section 3. This act shall become effective immediately
8992 following its passage and approval by the Governor, or its
9093 otherwise becoming law.
