Enrolled, An Act,
Relating to Talladega County; to amend Sections 1 and 3
of Act 91-522 of the 1991 Regular Session (Acts 1991, p. 923),
as amended by Act 2018-101 of the 2018 Regular Session, to
further provide for the employment and duties of the county
engineer; and to repeal Section 2 of Act 91-522, providing for
nominations to fill the position by the state highway
director.
BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
Section 1. Sections 1 and 3 of Act 91-522 of the 1991
Regular Session (Acts 1991, p. 923), as amended, are amended
to read as follows:
"Section 1. The Talladega County Commission shall
employ, supervise, and direct a county engineer who shall be a
thoroughly qualified and competent civil engineer possessing
all of the qualifications as specified for county engineers
under the general laws of the State of Alabama, who shall
devote his or her entire time and attention to the maintenance
and construction of the Talladega County public roads,
highways, and bridges, and ferries; and who shall reside in
Talladega County during his or her employment. Notwithstanding
the foregoing, the Talladega County Commission may waive the
requirement that the county engineer reside in the county by a
majority vote of the county commission.
"Section 3. Subject to the approval and direction of
the county commission, It shall be the duty of the county
engineer, shall perform thosethe duties prescribed provided

for in Section 11-6-3, Code of Alabama 1975, and a) to employ,
supervise and direct all such assistants as are necessary to
maintain and construct the public roads, highways, bridges and
ferries of the county, to have authority to prescribe their
duties, and to discharge said employees for cause or when no
needed; b) to perform such engineering and surveying service
as may be required and to prepare and maintain the necessary
maps and records; c) to maintain the necessary accounting
records to reflect the cost of the county highway system; d)
to build, construct new roads or change old roads, but only
when order to do so by proper order to do so by proper order
of the county commission; and e) to shall construct and
maintain all paved and unpaved county roads on the basis of
the county as a unit without regard to any district or beat
lines."
Section 2. Section 2 of Act 91-522, providing for
nominations to fill the position of county engineer by the
state highway director, is repealed.  
Section 3. This act shall become effective immediately
following its passage and approval by the Governor, or its
otherwise becoming law.
