1414 SYNOPSIS:
1515 There is no provision in state law that provides
1616 for political party registration.
1717 This bill would authorize the Secretary of State
1818 to create a form posted on its website to allow
1919 residents of voting age to register a political party
2020 affiliation with the Secretary of State.
2121 This bill would authorize the Secretary of State
2222 to provide a political party with a list of registrants
2323 with that political party under certain circumstances.
2424 This bill would provide for criminal penalties
2525 for violations.
2626 This bill would be repealed on January 1, 2027.
2727 Section 111.05 of the Constitution of Alabama of
2828 2022, prohibits a general law whose purpose or effect
2929 would be to require a new or increased expenditure of
3030 local funds from becoming effective with regard to a
3131 local governmental entity without enactment by a 2/3
3232 vote unless: it comes within one of a number of
3333 specified exceptions; it is approved by the affected
3434 entity; or the Legislature appropriates funds, or
3535 provides a local source of revenue, to the entity for
3636 the purpose.
3737 The purpose or effect of this bill would be to

6969 does not require approval of a local governmental
7070 entity or enactment by a 2/3 vote to become effective
7171 because it comes within one of the specified exceptions

7474 TO BE ENTITLED
7575 AN ACT
7676 Relating to voting; to authorize the Secretary of State
7777 to offer certain state residents the ability to register their
7878 political party affiliation and provide a list of party
7979 registrants to a political party in certain circumstances; to
8080 provide criminal penalties for violations; to provide for the
8181 repeal of this act on a certain date; and in connection
8282 therewith would have as its purpose or effect the requirement
8383 of a new or increased expenditure of local funds within the
8484 meaning of Section 111.05 of the Constitution of Alabama of
8585 2022.
8686 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
8787 Section 1. (a) The Secretary of State may offer on its
8888 website a form to allow residents of this state who are 18
8989 years of age or older to register their political party
9090 affiliation by completing, signing, and returning the form to
9191 the Secretary of State.
9292 (b) Any individual who knowingly completes or signs the

122122 form described in subsection (a) on behalf of another
123123 individual commits the crime of tampering with governmental
124124 records in violation of Section 13A-10-12, Code of Alabama
125125 1975.
126126 (c) Upon request, the Secretary of State, not more than
127127 four times per calendar year, may provide a political party
128128 with a list of all individuals registered with that political
129129 party.
130130 (d) The Secretary of State may adopt rules to implement
131131 this section.
132132 (e) For purposes of this section, political party means
133133 a political party described in Section 17-13-40, Code of
134134 Alabama 1975.
135135 (f) This section is repealed on January 1, 2027.
136136 Section 2. Although this bill would have as its purpose
137137 or effect the requirement of a new or increased expenditure of
138138 local funds, the bill is excluded from further requirements
139139 and application under Section 111.05 of the Constitution of
140140 Alabama of 2022, because the bill defines a new crime or
141141 amends the definition of an existing crime.
142142 Section 3. This act shall become effective on the first
143143 day of the third month following its passage and approval by
144144 the Governor, or its otherwise becoming law.
